6 + 2 Point Deductions

Long shot I know, but there may be multiple very serious cases against the Premier League that, on the face of it, appear to be difficult for them to justify.

Imagine a situation where Forest overspent by, say, £30m but are allowed mitigation for their Johnson sale (unlike us with Richi), and are given a 3 point penalty and a transfer ban, and then they finish 17th, survive, but are less than 3 points off 20th.

We would be all over the Premier League if relegated as their penalties were hugely different, as would those teams that did go down who could point to the Premier League not following their own precident set when they handed us 10 points and didn't allow mitigation on the Richi sale.

Or if Forest go down and we aren't given a penalty for the second change.

Could be loads of cases involving many teams.

I think it's incredibly unlikely, but not sure how relegations can be rubber stamped if court cases are ongoing where it appears obvious the Premier League has messed up big time.

We're the precedent here ultimately.

Everyone will have a better idea on potential punishments come the end of the season once we hear the outcome of our appeal, but there will be absolutely no certainty. If the 10 point deduction is upheld and (for arguments sake) Forest overspent by £30mill, then they have to get a greater penalty than us. Maybe 12points? Maybe more?

The likes of Luton (or anyone else battling to avoid the drop) would be smart to assume that any point deductions are going to be completely rescinded. The PL have turned this season into a farce.
 
Luton would still be livid. Imagine being told you're 1 pt clear of relegation, then because the PL effed up big time, through no fault of their own they fall into the relegation zone. You'd be annoyed. Not necessarily with Everton, but the inconsistency of the PL.
It’s up to them to decide which table they look at: the one where we are 10 points down, or the one where we are not.

The reasonable worst case scenario, for Luton, would be us getting all our points back on appeal.

If they aren’t working to that assumption, that’s on them.

They have won 9 fewer points than Everton. That's 100% their fault.

They can feel as angry as they like, but their opinion is irrelevant, or at least should be irrelevant to the outcome of the appeal. They weren't even in the league when the PSR breach occurred.

They won less matches and less points than us, so they don't deserve to be above us in the table.

I hear you, but as the Premier League is stating over and over, any punishment is at the discretion of the Independent Committee, which doesn't appear to be the same set of people for each case.

There is therefore absolutely no guarantee that, if Forest overspent by an additional £10m to us, they'd get a points deduction that accurately reflects that.

From what we all know, they went absolutely mad with their signings and barely offset it at all with a big sale, given the Brennan Johnson sale doesn't count as part of this breach. They might easily be £40/50m over, but there is NO WAY at all the league will hand them a 25 point deduction.

This is where the problems and court cases will arise imo.

Exactly, if anyone is to have a grievance then it would be Leicester. Luton have no say in this. If anything, their upturn in form started when we got the deduction, it put a little spring in their step as they knew they had a chance to stay up. Us and Forest getting penalised is their biggest shot at survival.
 

It definitely looks like tomorrow for the announcement , if not it will drag on until the middle of next week as they would not dare announcing it on Monday with a live sky game on tv and a very angry crowd.
If they don't give us any points back you can assume that we will be hit again along with Forest and that will finish us as far as the premier league goes.I have got to the stage now that I don't even want to play in the premier in its current form and look forward to the day that the other 14 clubs grow a pair and stand up to the six and stop being used as cannon fodder.
