6 + 2 Point Deductions

They all got denied by the PL and the commision in the report.
And that's what we need to be challenging - especially the points relating to sponsorship affected by the Ukraine war, and the fact we are building a stadium. We should be arguing the idea of a sporting advantage doesn't make much sense in our scenario.

I genuinely feel this are very valid mitigations, and I don't agree with the report.

During the 3 year period certain parts of building a stadium was covered then got changed and that part of the reason we went over
The stadium part is to do with us claiming interest charges against the stadium project. The interest charges were in now way linked to the stadium, in fact the documentation we submitted to support clearly stated the loan could not be used for the stadium.

The Premier League argued that the pre-planning stadium interest charges had not been incurred in respect of the Stadium because the stadium had not been funded by the commercial loans from Metro Bank PLC and Rights &Media Funding Ltd but by the interest free loans made by Mr Moshiri. In support of that factual assertion the Premier League pointed to a large number of Everton’s own documents, all of which showed that Mr Moshiri’s funds had been used to fund the stadium development. The Premier League also relied on the wording of the Metro Bank PLC loan application and the wording of the Purpose clauses in the commercial loan agreements with Metro Bank PLC and Rights & Media Funding Ltd, which we have referred to above.
