Canada Bus Killer not accountable

Determining mental illness is a very controversial area. I mean, what constitutes mental illness?Any definition provided can be applied to a wide array of criminals.

Personally, I dont think mental illness should be allowed as a case of defence. Enough isn't known about the brain - I spoke to a neuroscientist the other day who said the same.

Amazing that one man can do such evil yet get away with a crime because he is supposedly mentally ill.

You honestly wouldn't class him as mentally ill whatsoever? Just from reading that report its pretty obvious that by any stretch of the definition he was suffering from it.

Again the same question to you.

I agree that its very difficult to diagnose due to the fact its so hard for us to actually say right now what actually is mental illness.

Although i don't like the law as it stands now on mental illness we don't know enough in order to change it yet.

I'd guess that from what we do know about the brain and mental illness its safe to say that this man was suffering from it.

This is has Danny said, controversial but to add to the controversy, if we dont know that much about the brain, how can he get away with going to prison. Could anyone do this same crime, act mental and get of lightly??

Quite clearly, but aren't serial rapists mentally ill? - Do we send them to mental hospitals?

I wont bore you too death, but theres a worrying trend for mental illness as a case of defence. An issue considering literature concerning the brain is complete guesswork.

200 years ago people phrenology was deemed a science and widely accepted. I'll leave it at that.

Maybe yes maybe no. But you can't really compare your average serial rapist to the guy in this case, surely you can see that.

I'm sure there is a case for claiming serial rapists are mentally ill but based on what we accept now that guy has to be found mentally ill.

It wouldn't bore at all, i love talking and reading about this stuff.

Thats more when your average criminal sticks a pair of pants on his head and 2 pencils up his nose and claims he is insane that it becomes a problem afflicting the justice system though i'd of thought.

Unfortunatly it has become an easy option to go for the insanity defense. But as the law stands now it still deals in pretty simple laymans terms so by law pretty much anyone can say whether someone is mentally ill or insane really. Dcotors will argue about it all day long.

We have to go with what we now, can't keep hanging on until we are certain we know everything there is to know. Still a grey area and mistakes will be made but we have to make them in order to learn from them unfortunatly

You have to be mental to commit these sort of evil and sickening crimes, but to release them back into society on the opinion of a few doctors is, as you say, amazing. I believe Sutcliffe is making noises about release, he says he’s alright now!

If Harold Shipman and Fred West where still alive, no doubt they would have been walking the streets also. Where do you draw the line on this??

Its impossible to distinguish mental illness (the recent mental act made it so vague its untrue), so how do you distinquish which people are "mental hospital" mentally ill an who are mentally ill but can be treated in prison?

My point was, there is a worrying trend of mental illness being used as a case of defence. 10 years ago, he would have went to prison. Thats not my opinion, thats going by what other similar offenders received.

Who is to say in 10 years time, serial rapists wont be sent to mental hospitals on the grounds of diminished responsibility?

I remember this when it happened. It was one of the worst things i have ever seen or read.
whether he is mentally ill or not, he should never be free to do this again.
He should be locked up for the rest of his life.
No doubt in a few years we will read he is now a changed man, has found god and is no longer a danger to society. He will probably get lots of doctors and maybe even politicians and lawyers to believe he is sane. They will probably even consider him for release. :o

Sutcliffe is another who should never see the light of day. He will no doubt given the right circumstances kill again.

What a horrible thing.

One things for certain, he's madder than a big box of mad things.

I think the line is set at wherever the present society of that country considers is legally insane.

Theres no disputing he's mad as opposed to evil if that makes sense. Thought not.
