The CPS obviously decided they'd struggle to convict him on it even though Sec 3. says "destroying or damaging property by fire" should be chargeable as arson.

Looks like its going to magistrates. I mean he will be lower offence for arson and higher offence for criminal damage (given values involved, they count value over 5k as very serious).

The likely scale, is community service high level (big fine if he works) to probably a 1 year in the nick. Whether they charge for the arson or the lower offence probably determines where it ends up. Either way, quite the price to pay for trying to blow up the liver building to impress your fellow Kopites.

I’d think the value of the charge is going to be key surely ? if it’s relatively minor then he’d probably get away with the mags , if it ends up being the £10k that’s mentioned then I’d suggest that’s going the crown of only for sentence .
 

Well they probably need a sense of humour then . Look I can see why they’d find it distasteful but I imagine they find humour in some incredibly dark situations , darker than some dickheads doing a stripe of a hat that’s fell off .

If I was them I’d be more unhappy about a police chief posting congratulations and pictures of himself dressed up like dr fun then asking the hordes not to go down there whilst being unable to predict it’d kick off when it was as inevitable as the sun coming up tomorrow and not dealing with an unfolding situation because of families being present when the same Doesn’t apparently apply to blues and their families at the derby . I’d also try and pay for extra training for that copper with the beard that starts out With his bat out then the bottles start flying and he ends up in near enough Crosby by the time the filming stops .

I think it might be something to do with how those lads got the police hat.

Maybe from the two police that the Kopites attacked, while the police were trying to assist the seriously wounded man.

It wouldn't make any difference to those morons. If tens of thousands of blues gathered together to peacefully celebrate a massive moment they'd just spout nonsense like "small club yoos larrrr, when we win stuff we proper take over the city and go proper mental, that's why wer da best fanz in da weirld larrrrr!"
 
He's been charged with criminal damage. If it involves fire, it is charged as arson (criminal damage by fire) as per Sec 3. of the act.

So unless the reporting is wrong (i.e. the wording), the CPS have decided to charge with the lesser offence. Most likely, he'll face the bench rather than a trial.

Yes probably right. Hes likely a first time offender and so on intent he probably fairs quite well. It will be seen at the more serious end of criminal damage though, which can be custodial sentences of 1+ years. Here's hoping.
 
It may also be worth taking screenshots from reds who shared the images of the child being passed around. They may end up getting used, or best case scenario a visit from the police. They're all panicking and deleting now.

It won't be arson. I suspect his lawyer would have quite quickly pointed out something along the lines of: prove my client's actions (his firework) caused the fire.

"Okay. Will you accept a lesser charge of criminal damage?" "See you on Monday" etc etc.

Sorry, the value definitely does play a part. I've only just read that they're talking about a value of damage up to £10k, whereas I heard it was much less than that.

So, it'll depend if he pleads or not. If it's above the £5k limit, he will be sentenced at the crown regardless. It's also down to whether he's already got an ASB order.

If he has, he'd be in breach of that and would face a custodial. Oh..

It was the astro turf, which then subsequently damaged the building alongside other impact damage.
