If I was hazarding a guess, the second charge may be more lenient based on the financial trajectory of the three-year rolling cycle and actions since then.

Totally agree Phil. Any penalty proposed on the 2nd charge should automatically be reduced by a third ( unless we have done something crazy in the 2 subsequent years )
