If mitigations have already been factored in and have got the sanction reduced to 4, what exactly is going to form the basis of this apparent “appeal”?

Something along the lines of “don’t be arlarse!”

What it does highlight is our limp acceptance and self proclaimed victory and deification of ‘Super Silk’ after getting 6 shows how badly we presented our mitigations, especially in the media.

Surely this has to be the case…. Expect 3 point starting point (size of breach cannot be close to the 19.5m).

Working with the EPL for the last 3-4 years, positive trend, 2 of the 3 years already accounted for, and also let’s play ball should mean 3 points reduced.

Resulting in 0 deduction.

Yep. It's all in the phrasing. We did comply, but we gave them a 400 page document citing our defence which took so long to examine the season had finished and we'd stayed up. They can't say we did that deliberately, especially given what's happening with Man City, so they've said we misled, which we've been proven not to have done. They're making an unholy mess of this.

The verdict from the appeal specifically said Everton hadn’t acted in any bad faith. Everton even said how pleased they were this was documented. Now they’re basically saying we have them false info and use delay tactics. Which is it.

I always felt that Everton expressing pleasure in not being seen to have acted in bad faith betrayed that they could use that finding in any subsequent appeal. Add that to their comment in the first press release on the original charge about watching "very closely" cases involving other clubs, and I could see a plan coming toether...

But's it's Moshiri, so scrub that.
