6 + 2 Point Deductions


Surely the competency of their own decision making needs to be questioned as part of any defence / negotiation? They went down under Dyche but didn’t sack him until about 6 or 7 games left. They went down with Kompany but didn’t sack him, but they are blaming us in a season where we had deductions set by outside bodies at a time of their choosing, I’d be throwing their own inability to make decisions relating to managers taking them down as being the driving factor behind their relegation.
 
Good point, surely any legal action would need to prove that the breaches allowed EFC to achieve the 4 point advantage. As pointed out, it has been accepted that is not the case.
No it hasn't. It was stated that the sporting advantage can't be quantified, which you'd imagine means Burnley won't be able to prove it allowed us to get more points than them and they suffered any loss. That's not the same as accepting the advantage didn't allow us to though.

I don't think it did by the way, I think losing money the way we did made us much, much worse, but words are important.

They also have to prove that the sporting advantage was worth at least 4 points in that single season. The commission stated that the “inferred” sporting advantage would be across the cycle (4 seasons for that cycle).

We got a 6 point deduction for that cycle which suggest we gained a 1.5 point advantage per season.

The commission also pointed out they didn’t feel it was deliberate which I think will be important.

I’m agreeing with you here. They didn’t say there was no sporting advantage. Just by breaching there is likely to be one.

Ultimately the commission tried to quantify it by giving us 6 points. It’s now on Burnley to prove that at least 4 of those points would be in that 1 season. Which they can’t and won’t do.

I know, wasn't having a go. Everyone went on about it only being inferred for ages, drove me crazy. You're correct, they can't prove anything, and that should be case over.
 
I still haven’t had it explained to me how WE are in any way involved in this. Why aren’t they taking the league to court over this? We don’t owe those little tin pot scruffs anything, their gripe is with the Premier League for delaying the hearing and the application of the punishment to the next season. Weird that anyone at Everton is even entertaining this.

That is true. The sporting advantage thing seems a bit consulated in the report but you can certainly say it exists.

But they can't stipulate it's impact. So it's not probable we gained any points from it.
 
Probably think they’ve got a better chance of winning by going after us rather than the league

Not no more now we have Marshal Dan Friedkin at the helm. We’ve got a Texan who can strut sitting down, with more guts than you can hang on a fence, more money than you can say graces over, a real three jump cowboy who’s as serious as the business end of a .45

He’ll have these Burnley knuckleheads looking dumber than wagon wheel faster than a prairie fire with a tail wind.
