i've always considered them a biscuit but they are in fact by definition a cake, they would have been changed to biscuit years ago under european law if that was the case.

The basic Jaffa cake design is the marrying of three elements; a sponge cake base, an orange jam center and a dark chocolate covering.

It seems that officially they are cakes. Apparently the manufacturer won a case against the Inland Revenue. The IR insisted they were biscuits, and thereby liable to VAT at 17.5% (choc biscuits are luxury items). The maufacturer claimed that they are cakes, and not liable to VAT (cakes are not luxury items, for some reason).

I still say they're biscuits and McVities probably owe the IR millions in tax.

they are synonymous with 1 brandname too. all the rest are just pretenders to the throne, and it's just so easy to choff a boxfull in one go, in fact i cant remember ever putting an opened box back in the cupboard.

Either way, they are tasty, and cost a pretty penny to get over here on this side of the Atlantic.
