If the waitress wasn't doing her job properly to a point of utter ridiculousness you would complain. As you have paid money to be at the restaurant for good food.

You're right. Spitting implies that he's doing it deliberately. It's more like spilling food on you all the time through sheer incompetence.It's not is it really, again if you think that sort of behaviour is ok then go for it
