I was making the point that 'intent' which Neville was going on about is not mentioned in the rule, rather than saying it was definitely a red.
To answer your question though, the mention of use of excessive force comes after the word 'or', so isn't necessary, provided the safety of the opponent is endangered. The question is therefore whether or not that was the case.
