So your saying the first should get seven years and the second a non-custodial sentence?

Important to think what kind of message that would send to society.

"Don't worry kids, you can drive drunk, at twice the speed limit, kill someone, try and blame someone else and you'll be let off"...

Difficult to say because I've not sat through the cases. My initial instinct is that number 1 deserves a lengthy prison sentence. If I heard a convincing sob story, I might have gone in at two or 3 years. If she didn't convince me, I'd be looking at a bit longer, maybe the seven years I initially proposed.

The same would go for the second case. My instinct is a terrible accident, and an immature young woman that will learn a harsh lesson. If no evidence came to light to tell me differently, I'd be lenient.

Case one:

Case Two

Number 2 got a stiff sentence, and she she's only got herself to blame. I can understand the amount of time she got. Like you allude to, it sends out a message. Was she callous or vicious in her actions? If so, then I'm glad she's serving hard time. Was she just an unfortunate and silly girl that made a series of wrong decisions in a relatively short time-frame? If so, I hope she gets out soon and can rebuild her life.

Unless I find out that number 1 has an issue that relates to her being unable to comprehend the seriousness of her actions, then I'm happy with her sentence, and hope she serves the majority of it.

Anyway, I would have given the 1st chick 4 years and made her have her womb taken out. And the 2nd chick I would have let go free, she didnt kill anybody but the passenger, who no doubt bought her the drugs and the booze that was on when she was driving. He knew the risks.
 
1st one got 14 years.

2nd one got **** all, she killed a smackhead, i'm not arsed here lad.
 

If I was judge:

Case 1:

The accused would be found guilty of wilful neglect by virtue of leaving a child alone or unsupervised "in a manner likely to cause unnecessary suffering or injury to health" (Children and Young Persons Act 1933) and sentenced to the maximum term of 10 years.

The accused would also be found guilty of perverting the course of Justice and would serve 2 years to run concurrent with the first sentence.

Case 2:

The accused would be found guilty of causing death by dangerous driving, section 1 Road Traffic Act 1988 and sentenced to 5 years imprisonment, plus a mandatory two year disqualification.

Right, your a judge. Sentence these two cases;

Case One;

A 38-year-old mother, left her 20-month-old daughter alone in a house. The 20-month-old baby was deliberately put in a rear upstairs bedroom so she could not attract any attention or be heard crying. The mother was known to social services and it wasn't the first time she had left children home alone.

During this one instance of the daughter being left alone, an electrical fire broke out and the baby died.

Friends of the mother have also confirmed that she asked them to lie and claim they had been looking after the child in her absense.

Sentence her.

Case Two;

An 18-year-old girl was found guilty of causing death by dangerous driving.

While driving at up to twice the speed limit on a winding 30mph road, she span out of control and crashed in wet conditions, with her front seat passenger, an 18-year-old man, being thrown out of the car and dying from his injuries.

Although the police never took a breath test, the woman was returning from a night out and strongly suspected to have been over the drink drive limit. The passenger was also found to have cocaine in his system.

The woman also lied about being the driver, claiming the deceased passenger was the driver - but forensic experts proved she was indeed, the driver.

Sentence her.

first one deserves jail time for sure. I would say around 6yrs would be the sentence they will give her. I would give her double that.

Second one again should be jailed. I would say around 2ys is what she will get. I would give her 8yrs at least.
 
I largely agree with Nebbiolo. I'd be inclined to knock 2 or 3 years off the 2nd sentence & add it onto the 1st one. Apart from anything else, it sounds as though the passenger who died wasn't probably wearing a seatbelt, which may well have saved his life & so altered the nature of the charges to be brought.

Case one............She should be Hanged by the neck till she is Dead
Case two............Serve Jail term of 10 years
