10 points for a few minor miscalculations is quite excessive tho really.
I think this is what everyone has come to agree on. Nobody denies that we have overspent on crap, it's obvious to everyone. We also very clearly tried to do everything we could to hide it per the report.

A higher point deduction for overspending by 19 million than going into administration is farcical though and nobody thinks it makes sense.

Anywhere around 5-6 I think we all could have took it on the chin and moved on. Dumping us back in the relegation zone after forcing us to sell our best players and being in relegation battles two years running just really isn't on.
 

So, we've been running every financial decision past the PL since 2020, doing everything they say. Selling players almost at their request. Not spending on players, almost as if we've been on a transfer ban.

After what they've just done to us, I wouldn't give them time of day now. Simply submit our accounts every year and make sure they don't show us being over the 'limit', in the same way every other club has.

It's the cooperating and following of the PL's direction that's lead us to then royally shafting us. My biggest worry now is that this bunch of idiots are the ones running the rule over our potential new owners. I wouldn't trust them as far as I could throw them.

Yeah, you're not wrong about the fact that they changed the rules but the fact is that our payday loan from Rights and Media funding was clearly never intended to fund the stadium and any attempt by us to claim those interest payments as stadium related is clearly fraudulent. Reading through the report I am genuinely embarrassed by that.
 

The City case is a funny one, the German paper who got the leaked emails released them in 2018.

Now City have prolonged legal battles over how these emails were obtained ( hacked they were )

It's a massive case and City's legal team will prolong it for a few years by the looks of it.

Moshiri signed Mylenko and Patterson because the Premier League initially believed the line about the loan interest being deductible from P&S calculations because it was being used to fund the Stadium. That fell apart when the Premier League investigated the loans further.

From the judgement.

Use of Funds
If the facility is successfully completed, the funds will be used for working capital facility
purposes. Hence, in the same way as the Rights and Media Funding Limited facility this
additional financing support will be used for operational purposes during the 2020/21
season.
We do not intend to use any of the funds for the new stadium project or to buy players in
the transfer window. These funds will be used to continue to support the Club and all of the
activities that the Club are involved in for the term of the facility.
That representation is incorporated into the Metro Bank PLC loan agreement
dated 29 April 2021. Clause 2.3 reads –

The Borrower shall apply all amounts borrowed by it…towards the payment of
indebtedness and its working capital requirements.


The terms of the loan clearly state it wasn't for the Stadium. The premier league then uncovered Everton documents that showed the Stadium was being funded by interest-free loans from Moshiri.

1 thing to consider, the precedent has been set. Punishments are seemingly current and not backdated. You will not be awarded for any posthumous 2nd place finishes achieved with Blood doping.

Maybe, but there's been 4 good reasons why we couldn't account for that £19M overspend and anyone one of them would have brought us back into line had they been accepted - which is what any reasonable attempt to administer justice would have done.
