6 + 2 Point Deductions

Agree the loans will cease to be a liability upon the takeover and will be removed from the balance sheet.

I don’t think we definitively can say the historic treatment of the cost of those loans won’t be looked at again though. If the PL determine they must be fair value priced from date X, it would be unwise to assume they won’t backdate that too. I don’t believe this is consistent with industry accounting standards but the PL have shown themselves to be a law onto themselves.
There's absolutely no way the Premier League will change the rules, which I might add needs to be voted on and agreed by the majority, and then back date them to catch clubs out.

They'd find themselves in court defending another legal case which they would categorically lose.

TFG will have to workaround the £260 odd million they’ve leant us I’d be surprised if there not sitting as loans.

14 clubs have to vote on a rule change anyway dont they.

In my opinion, TFG will settle the R&M and ACAP debt and recoup/pay that off through taking out a loan against the stadium. I think anything they have lent the club will be converted to equity.

Let's say the R&M and (reduced) ACAP debt total £265m and the money TFG have lent the club plus Moshiri's settlement is circa £300m. I believe they will convert the £300m to equity and will take out say a £350m (relatively) low interest mortgage against the stadium to both settle R&M/ACAP debt, give us some further working capital, and immediate transfer funds (PSR dependant).

All just my opinion of course, and I could be completely wrong, but i expect it will be something along those lines.

Ultimately, the more money they put in and convert to equity the better off we will be. I'm hoping they will convert all existing debt to equity and use a mortgage against the stadium to help invest significantly in the playing squad but that's extremely optimistic.

I haven't looked into it but it seems there was at least a couple of damaging defeats there for the league. Was anything ruled illegal yesterday something that was used against us by the Premier League and contributed to us losing 8 points, millions in prize money and restricted our ability to add to the squad for four transfer windows and caused us to sell one of our best players? If so, it's basically a 100% certainty that we win any case we bring against the Premier League. There can be no way that Everton do not go after extensive compensation from this.

Maybe 99.9% certainty as Everton have developed a habit of snatching defeat from the jaws of victory lately.

I haven't read to much on any of it, but if the sponsorship thing has been deemed illegal than surely we can argue the case on losing USM money from stadium naming rights?

No, I don't think so mate. Only just catching up myself, but it looks like the points the PL had its eye wiped on were to do with their definition of Associated Party Transactions (APTs), and the time it took them to share with City their findings on a couple of specifically proposed transactions.

The only way this represents a victory for anyone other than the PL, in my opinion, is that it has sown a seed of doubt in the PL's ability to put together a 100% solid framework for APTs, and therefore I imagine there'll be an attempt to carry that doubt over into their handling of PSR - handily for City, right before judgement is handed down on their 115 charges.

The only implication for us that I can see (and I have literally just read a couple of summaries) is that we were one of 3 witnesses for City versus 8 clubs that turned out in favour of the PL. Hopefully there's no spiteful retribution involving ratification of our takeover, etc. Wouldn't put it past the horrible mutts.

I think City's "victory" in that regard was purely down to the PL taking too long, and providing inadequate info as to why their proposed sponsorships were turned down. Unless we can show those same failings, we wouldn't have case on the back of all this.

Yes and no and no again.
