It would appear to me based on the reading I have done, that in mitigation the Ukraine war and the inability to sell Player X really hadn’t been substantiated with any sort of audit trail / paperwork which is partially why those arguments were dismissed. I agree with most that the judgment has been harsh and the sanctions clearly motivated by a political agenda, but we may have been more successful, if we had paperwork to back up our mitigation if we had been ran well like a proper football club and actually prepared our case better.

Agree with this, on face value it's reeks of retrospectively trying to spin a story and narrative that allows us to explain away the loses, rather than the mitigation being robust and legitimate evidence based argument - which would explain the lack of trail.

Just highlights how poorly the club has been run with what appears to be a very blasè 'they won't do anything about it' type attitude - pity the folk making those decisions are not around anymore to be held accountable.

Still...doesn't take away from the punishment being ridiculously harsh and hopefully be remedied via the appeal.
 
True but if we aren't pushing the envelope to improve then we may as well give up now as I don't really want to support a team that are just happy to be in the PL. I understand why we took risks and as always we got the worst possible outcomes due to world events screwing us over.

Basically in accounting terms when trying to budget across the three year period we have to assume the lowest values. That we'll finish 17th for our placement payment. That any player we buy will do an ACL or have a double leg break and become immediately worthless. That if our shirt/kit sponsors are due to expire during the period that we'll only get 25% of what we had. And if we take that all onboard to avoid any penalties then we'll end up with the equivalent of 11 Shane Long's.

...Which is exactly what the top clubs want as we'll cease to become a threat to their incomes.
I think there is balance to be had tbh - taking risks is one thing but some of the risks Moshiri havr taken were pretty crazy eg It didn’t occur in the period we’re being docked points for but hiring Benitez was a fairly predictable disaster on and off pitch and also cost us 10million to fire. I don’t think a well run club would have taken on such a risk.
 
Two things for me.

Are we guilty and do we deserve -10?

Yes, to the first. Of course we are, and not because of Covid or Ukraine. But because we are a terribly run football club.

As to the second, of course not. An obscene punishment that does not fit the crime. Everyone who is being honest can see we are being thrown under the bus due to the impending regulator.

I get your point. You'd have to mitigate that the war in Ukraine affected Everton massively. Dismissing that which I think the IC did, is ignorance at best.

What bothers me is the same Everton denied the claim from the PL that they had made a breach and said they would defend it robustly. Lo and behold, we
are guilty after all, and we accept that, but we didn't accept the figure & then came the 10 points.

This is all my rrrr's. The PL are making an example of us to ward off an independent regulator. They are gunning for us and yet they've rigged punishment against the breakaway 6 to diddly squat, and will do likewise for City's 115, whilst there are other clubs in different ways, IE Chelsea, Newcastle (Saudi's) that have big big questions hanging over them. And the IC have screwed us over not least saying we had no sporting advantage and then gave us a sporting punishment. There are many holes in my opinion from what the IC came out with. I don't think they were impartial either they were certainly directed by the PL and the participants appear to have conflicting interests (other PL club ties) and also interestingly, similar background, shall we say, to Everton FC.

Everton fluffed it effectively first time around, and may have anticipated a different kind of punishment. They better not mess the appeal up.

You would think (any sane person) that you could not be found guilty of a charge for something that two thirds of a new charge relates to a charge that has already handed down a penalty… in other words, found guilty again for the same accounting periods twice.

Then again with the “independent” kangaroo court comprising of Masters minions who have plenty dirty hands themselves, who knows…

@theesk has put together his first review of the independent commission that considered the alleged breaching of Premier League Profit and Sustainability regulations and the resulting sporting sanction imposed on the current manager, players and most of all the fans for problems completely the fault of an incompetent owner and now departed incompetent Board of Directors.

To be honest this doesn’t tell anything much. I sat and read the whole 48 page document the other night. It was an interesting read, but yes this does basically sum it up.

that sounds close to double jeopardy, I don't think it is but a similar principle
