They had to come up with a sentencing framework because no one had been daft enough to fall foul of P&S rules before. It was nothing personal if any club had breached P&S rules then they would have had to come up with a formula.

The silly thing about bringing it up is that the IC ignored it. The premier League's formula recommended 9 points. The IC gave us 10.
Why did they have to come up with a sentencing framework? It was the commission's responsibility to decide the sanction, as outlined in the handbook. Why did the PL feel the need to influence the 'independent' commission like that? I asked you this the other day and you never answered.

It took on extra significance when it turned out it wasn't a framework the PL intended to keep in place.
 

Just I thought. Might be totally off here but I read somewhere that Everton cannot take this to a high court or a court of arbitration. If that’s the case is this really law?
This premier league reasoning for our punishment has more holes in it than a 2nd hand dartboard.
Can we not get all the fan groups together and sue the premier league ourselves as we the fans are being punished. It’s not our fault with their corruption. Isn’t that the buzz line with the scum 6 clubs?
I think we’d have a decent case personally. Instead of raising cash for flags etc for protesting (which is brilliant by the way) get the money together for a legal team.

It is a perfectly normal practice that happens throughout football though. In disciplinary cases the governing body acts as the prosecution and the club appoints lawyers to defend the charge. The IC is in effect the jury.

It is up to the Premier League to come up with aggravating factors and it is up to the club to come up with mitigating factors.

One of things not mentioned enough is that it's the fans who have been trying to get the board out of the club for a long time, the punishment doesn't really fit when the PL have done nothing but watch as the supporters knew things were being run badly and were fighting against it - the excuse of "they have a wealthy owner so a fine doesn't fit" doesn't work when it's exactly the punishment that was needed in this case (individual punishments for all those in charge at the time). This is the Premier League ignoring the situation and then punishing the fans who were trying to force change (with no real ability to do so).
