As I get older I tend to agree with the ACLU types more, which I never would have expected. We should be able to have a society where people are literally free to say whatever they wish. The problem is that, at the moment, it doesn't work. This person is a symptom of much greater social and cultural problems, and he epitomizes the degree to which communication in this country has become manipulative and dishonest for personal gain.

If this country were inhabited by actual grown-ups, this man would not have an audience and literally no one would care if he spouted these vile lies. The harm done stems from the fact that he can attract a large audience. Since we can't seem to educate a large swath of society to the point where they recognize that someone like this is a con man and dismiss him out of hand, we have to take ownership and deal with it. This is equally true of another, more famous con man.

I don't have the answer on this one, but it's a discussion we need to start having yesterday.
We do have a society where people can say whatever they wish, but too many - generally those who wish to say vile, bigoted, harmful and often untrue things - conflate freedom of speech with freedom from consequences.

This guy had a ready made audience of people so racist and/or wedded to their stupid guns that he made an absolute fortune saying the deranged crap he knew they’d gobble up without ever having the slightest desire to question it. There isn’t a punishment, civil or criminal, that will even come close to being enough but I really hope that theory is tested to its absolute limit in the coming months and years.

I think you've missed the point. The problem is the existence of an audience willing to do violence in his name. You're taking that as a given. I am not.

The "freedom from consequences" argument is unnecessarily self-righteous in a way that tends to shut down conversation immediately. It is also more or less exactly what Madison warned against in Federalist 10.

Is it not a given that there’s a large portion of the American population that are so rabidly bigoted and in love with guns that they will blindly leap to support/defend anyone with a platform, willing to spew forth any manner of disgusting bile, so long as it’s in their interests?

Forgive my ignorance but I’ve had to do a quick Google on that one - Wasn’t essay #10 to do with factions and Madison’s concern about - heaven forfend - citizens acting in their own self-interest? I am not sure exactly how that pertains to what I said? Of course, everyone can say what they wish but if what they say is hateful, bigoted, etc, then there should be consequences for that, no? That’s the kind of accountability that should make people think twice before spewing forth Alex Jones levels of bile in future.

With ‘rights’ comes ‘responsibility’, you can’t have rights without responsibility or everyone behaves like a pubescent 14 year old demanding to have things their own way whilst accepting no responsibility for the consequences.
 
Just imagine your child gets gunned down at school

Then imagine a horrible fat sack of hate pushes a narrative that your child wasn't killed at all, but it was faked and you are faking your grief

Imagine this then leads to nutters who believe this stuff harassing you and your wife, to the point that you have to move house multiple times and it even gets so bad that you can't visit your child's grave under fear for your own safety

If someone does that to you then I think you should be legally entitled to punch them until they cease to live

He will probably be back on air pulling in more money than ever before in a couple weeks

Thats only the first round. Today the jury has to determine punitive damages and another decision next day on other damages. That was just the first course of pay out orders.
