Any Legal Boffins Here?? for sensible advise

Wednesday night, probably about 10/11 pm i was down in connahs quay with my girlfriend and her mate and was heading back to my girlfriends house, and this black corsa with a single female in the car started driving up my arse up wepre lane (windy lane quite narrow)

she was driving very very close, in fact i couldnt see her headlights for about 1/2 a mile so i put my fog light on and off briefly just to kind of say, back off !!! because i didnt want to speed up and she was driving dangerously close

anway she briefly backed off then came again very very close again and continued tailgating, i got to a junction and stopped, turned around in the car and put my hands up and said "what ????" obviously she couldnt hear me but she knew what i meant...

i drove off and again she continued before she turned into a pub, so i turned around a bit further up the road, and drove in.

sat in the car and opened the window and waited for her to get out, when she did i asked her what her problem is and why she was driving so close up my arse... she said she wasnt... and i just said... yeh you was i couldnt even see your lights... and she said no i wasnt and just walked off..

at this point i had to do a U turn to get out of the car park, i drove out and because of loose stones as i had full lock on obviously some usual gravel noise was made as the car turned on them... she turned around as i did this...


anyway today my dad got a knock by 2 police cars... asking for me!! and saying it was a friend of their and that i was being threatening , acting like a gangster and driving dangerously.

he gave them my mobby number, and then rang me once they left.. i wanted to get in touch asap with them so called the local station but no record was on file etc..

anyway they finally phoned and saying he was rude was an understatement... he accused me of being a bad driver, said i was threatening, told me i should have continued on driving and increased the distance between the 2 cars (how????)..

he wouldnt listen to what i had to say and said i have to come to the station in the morning to have a talk and listen to my options, i asked what they might be and he wouldnt tell me until later on in the phone call..

i tried to advise him of my point of view but he wasnt interested to be honest, and even when i managed to tell him, he said i broke the law because i turned around and went back to approach her!! i should have reported her (but how could i get the reg plate, it was 2 close???)

anyway he said the options where

he could lock me up
give me points on my licence
give me an asbo
give me a section 59
take me to court
or do nothing

i said, but i have done nothing wrong other than ask what her problem was.. and he said, its not what she says, and who would the court believe a member of public or a police officer...

anyway dunno what to do... im not willing to accept any of them concequences for something i havent done...

any advise would be brilliant ?? obviously its very biased because of work mates etc
 
Im not a legal boffin or nothing ......but just tell him to fukk off.If he would have phoned me i would of just laughed my head off at him!!!

Take you to court,lock you up,points..........for what!! i'd tell him to go for it. He'd probably [Poor language removed] himself.

Just tell him you have a witness that swares she was on her phone or aplying lipstick or somthing.....he's just trying to scare you,load of bollox
 
Note everything that was said and get a solicitor. Dont be having any of their [Poor language removed], youve got them by the balls after their admission it was their mate as:

1 - Theyre meant to be impartial.
2 - You have two witnesses, she has none.

Sounds like its her word against yours.

No matter what a police officer says, they can't prove you were driving dangerously (unless there is proof by camera or other witnesses) - and even if you were doing ten miles an hour she has no right to tailgate. If you had breaked sharply and she had gone into the back of you - the chances are she would have to pay a resulting insurance claim, as even if you break for no reason, the person behind should be a safe distance from you.

You went wrong going back however. And she has probably claimed you harassed her.

Best bet is to get a solicitor and go into the station with him.

Unless she comes up with a bogus witness I can't see it going anywhere.

She probs turned on the waterworks to the copper.

[Poor language removed]' typical police "gangster" mentality.

Threatening someone for hypothetically threatening someone.

bad bad logic there.

i agree... i shouldnt have gone back and i was pissed off because of how it happened.. and the fact that normally as soon as u tap the break people back off etc but she never..

their is no cctv or evidence etc and her word against 3 people.. but i dunno

should i make a complaint about her driving ? or is it too late now??

he said i was swearing at her, but i said ... you where driving up my arse... its not illegal to swear is it??

as for harrassing... is she being threatening by driving dangerously??
 
Depends mate. Context and all that, but it could be considered verbal abuse. Especially in todays world.
 

Get witness statements off the two others in your car.

Fight your corner, I dont think the officers boss would be happy that he was acting in such a way and acting in the interests of his friend.

Tell them they've got a riot on their hands unless you get Chomp Bar every week for the rest of the year. Slam your hand on the desk when you demand this for extra effect.
 
If you have a solicitor I'd suggest talking to them. To the layman it doesn't sound as though they have much of a case but I don't think any of us are experts and we've only had your side of things. Best to get a proper opinion. Quite a few places offer free consulations so the first meeting might not cost anything.
