I think the case is you get automatic copyright on any image you make, if he can prove that he took the image then he has the rights to the image

I think you may be right there mate. Whoever takes the pic is the copyright owner unless the photographer makes it copyright free ( free to share ). I will ask my colleague as he will know how it works on that score.

America has the fair use doctrine. So his image could probably be used for news reporting without violating copyright laws in America.

I have no idea how it works with social media. But I certainly wouldn't take the case without a large retainer.
