You can't sue them; it's fair use as it's published in the public domain and the re-interpretation of the image without watermark is acceptable if ownership wasn't implied in the first instance.

The Mail have been known to pay up on images published on twitter when people have bothered to pursue them. It's not that clear cut.

Ownership was implied in any case as he stated he took the photo...

He did take the photo and he retains copyright even if it was published in the public domain

He'd only have a case to sue if they did not remove the image or they (the parties) could not agree licensing of it.

Unless its been uploaded to a site which terms and conditions state that its allowed to be used then thats correct mate, example being facebook (i think) owning the rights to use your pics unless you stipulate they cannot be used etc

Exactly. If you (copyright owner) upload it to a website which in its terms and conditions you waive copyright rights (eg send image to bbc)

Unless you do that you have not waived copright.

The complicated bit is the US. There a person retains their image rights of photos taken of them. In uk that only applies to PRIVATE places eg. Home


Oh and if someone else who isn't the copyright owner uploads it to one of those sites. They cannot waive YOUR copyright. They had no valid rights to the image or waive it on your behalf in the first place

THats all correct. True about the BBC as well. Every contract I've ever had with the Beeb gives them the right to use my voice/image in any way they like,on any medium, current, or not yet invented ! Plenty of leeway there, then !!
 
I don't know lads, reminds me of the time I sent those pictures of meself to Mila Kunis, they reproduced them in court, I called copyright infringement but the Judge was having none of it.
