He did take the photo and he retains copyright even if it was published in the public domain
Unless its been uploaded to a site which terms and conditions state that its allowed to be used then thats correct mate, example being facebook (i think) owning the rights to use your pics unless you stipulate they cannot be used etc

Unless you do that you have not waived copright.
The complicated bit is the US. There a person retains their image rights of photos taken of them. In uk that only applies to PRIVATE places eg. Home
Oh and if someone else who isn't the copyright owner uploads it to one of those sites. They cannot waive YOUR copyright. They had no valid rights to the image or waive it on your behalf in the first place
