Well, they send me a label to attach to the pallet

They made the mistake with the label and you made the mistake of not checking the label and attaching it to your goods.

So what’s fair and reasonable there? If you check the label then their error is noticed at that point and they just issue a new label. Only you didn’t and it’s ended up on the wrong continent.

Personally I’d try and amicably negotiate a reasonable settlement with them, as I’d not fancy your chances in court with that one tbh.

Any one with any legal knowledge?
I sent a pallet to the USA a while back (February) using a shipping agent that I use regularly. The label they gave me to attach to the pallet was actually for India!

The pallet is stuck in India and they want storage fees to release it (£1200) and return shipping to be paid. The agent who I have used for years are saying that because I put the label on the pallet, I am at fault and liable for costs.

If someone sends a label with the wrong address is it reasonably foreseeable that you would then apply that label blindly to a pallet and send to India? Or is it reasonable to expect someone to just ask for a new label? There should be something about it in your contract anywhere possibly about your responsibility to check labels
