Barrie Hawkyard, 69, who worked on the Wirral, walked free from court after being found guilty of molesting three children and a woman.
The former superintendent, who served in the Cheshire and Greater Manchester forces, was convicted of eight indecent assaults in July.
But Judge Robert Warnock handed Hawkyard a three-year conditional discharge following his trial at Liverpool Crown Court.
The Attorney General, Jeremy Wright QC, today urged three top judges to increase his “unduly lenient” sentence at London’s Court of Appeal.
Hawkyard, now of Foxglove Close, Evesham in Worcestershire, worked for the Cheshire constabulary when it had responsibility for parts of Wirral.
The pensioner, who later become a police consultant and accident investigator, preyed on three teens and a woman in her 30s between the 1960s and 1980s.
His final assault on a married woman happened when he was in uniform and “cupped” her breasts from behind, said Lord Justice Lloyd Jones.
The court heard he denied any wrongdoing and the women who testified against him at the trial had done so “reluctantly”.
One of the women came forward to police after reading about Jimmy Savile’s crimes and the other women then made statements to officers.
The jury acquitted him of charges of rape and indecent assault on another female.
Judge Warnock said Hawkyard had been an “arrogant and presumptuous young man, who thought he could treat his victims with impunity”.
Yet after an hour-long hearing this morning, Lord Justice Lloyd Jones, sitting with Mr Justice Knowles and Mrs Justice Thirlwall, declined to up his sentence.
He said Judge Warnock, as the trial judge, was best placed to assess the seriousness of Hawkyard’s crimes.
Lord Justice Lloyd Jones concluded: “We do not consider that he was bound to impose a custodial sentence.
“Some might regard this as a lenient course, but the pragmatic course he took was not unduly lenient.
“Accordingly we dismiss the application.”
The maximum sentence for historic indecent assaults committed against victims aged 13 and above is two years behind bars, because this was the law at the time.
