I'm sick of this whole "Wigan's players were going to go anyway"

Man United fans are patronising us the same way that you are patronising Wigan

I'm amazed you can't see it

Mate being sick of it doesn't make it not so - Wigan will be shifting players because that's what they've been doing since the day Bruce went (all about the wages see).

Just not comparable to Moyes actions... no way, no how, no sirree bob
 
It's DIRECTLY comparable because IT'S THE SAME BLOODY THING!!!!

Whelan is open to offers for his players, he said so. They will get more than a fair price for Kone if the reports are true.

Apart from those two minor differences, 'it's the same bloody thing!'.
 

Almost certainly this would not stand up in Court if challenged - "restraint of trade"

I think it would stand up in court perfectly well.

Most executives in business are required to sign contracts forbidding them poaching clients or staff for a specified period of time after he or she moves to a rival company.

But I don't see the point of it in football insofar as if the player the departed manager wants is anxious to join him then his head will be turned and the club might just as well screw as much dough as they can for him.

That is because (i) trade secrets (ii) know-how and (iii) trade connection (ie coming into contact with clients) are all recognised as areas that can be protected by such agreements. Stopping a player move from one club to another is anti-competitive.

Moyes and United agitating for the sale of a settled player at a club he's happy with and who has stated recently he's looking forward to working with the new manager is "the same bloody thing" as going after a player (Kone) who is available and WANTS to come to Everton????

Why? Their ex-manager hasn't come in uninvited with a pisstake bid for a player. He's come in, apparently, with a more than fair bid for an ex-player who's openly stated he wants to leave Wigan...thus prompting bids.

It really isn't a good fit this 'Martinez is doing the same' argument is it?

I think the part which is getting people wound up is that Kenwright came out on live television and said that he has asked Moyes not to come for Baines. If Kenwright and Moyes really did have had this great working relationship over the last 11 years like they say they did, then you would think out of a matter of respect, that Moyes would respect the wishes of the man who has made him one of the best paid managers in Europe, by not going for our most important player.

If you can't see the difference between that situation and the Wigan/Whelan situation, then I think you would blindly defend Moyes through anything.

I can't believe that there are still people on here who are just saying: "what's the big deal? That's football". It's time we stop letting people walk all over us.

Ha would prob be the one time Bill would dig his heels in and say "not selling our best players".

Cos you're talking turkey.

You don't recognise the essential differences kindly pointed out by Davek, myself and others if you counter with more than "it's making you sick" you might have a shot but it's difficult to see.

Bit liking flying a kite in the park and saying it's the same as being a commercial pilot - yes you are controlling kit in flight but there is a bit more to it.

The analogy breaks down though...

Martinez is not still an employee of Wigan Athletic,

Martinez was not given access to the squad for 2 full games after accepting a job with another club

Baines has not come out and stated that he wants to go to another club.


In general, managers go for old players, which is fine. But it's a bit different in that given the long relationship Moyes had with the club, we didn't take certain precautions out of trust. We didn't force him to buy out of his contract or run it down before discussing terms with Manchester United, we didn't keep him away from the first team squad to prevent him from turning heads. Moyes' situation is very unusual, Martinez's parting terms with Wigan was pretty typical.
