Didn't really know where to post this so apologies if it's not the right place. Was out at a party tonight and got talking to a girl my Mrs knows. She works for Martinez's agent and said apparently Roberto is taking us to court for wrongful dismissal, don't know if anyone else has heard this
How is it even possible for a manager to claim wrongful dismissal?

How can he even think to do that?! Martinez has to be taking the pee surely?

How is it even possible for a manager to claim wrongful dismissal?
I don't know how the law works for football, but for most employment contracts unfair dismissal can be fought if the employer did not suggest ways of improving the employee's performance and/or give them the opportunity to improve.
He might have a case if he was never contacted by Moshiri or Kenwright/whoever about the risk of being sacked before hand, then turned up to Finch Farm that morning and was told to do one.

Law probably works differently for managers though.

No footballer manager goes down the "unfair dismissal" route as there is a statutory cap on compensation of £79,000.

He would have to go down the breach of contract route. That would be dependent upon there being, or not being an agreed payment termination clause - highly unlikely that there is not such a clause in his contract. However if there was not such a clause then he would pursue "breach of contract" and the resulting damages.

Like the rest of us, he is paid to do a job. If your employer feels you are not doing the job you are getting paid for, can they not sack you for incompetence? (he was definitely incompetent)
 
Love this me, under moshiri we are just like if we want something we will get it. Up the toffees.
Some of us are getting ahead of ourselves. I don't read everything here - haven't got the time - but I haven't seen a single thing
anywhere telling me what Moshiri has said that he intends to do here and how much money will be made available to the club.

He may not have made a decision himself, yet.

Iv no idea mate, I'm just saying what the girl said to me. Maybe she got it wrong but he's taking us to court for something

Interesting. Is it common for managers to do that? And I thought we paid him something around £5m, would that have been the termination clause?

Like the rest of us, he is paid to do a job. If your employer feels you are not doing the job you are getting paid for, can they not sack you for incompetence? (he was definitely incompetent)
If you've worked there for at least a year, they have to notify you of unsatisfactory performance and suggest ways to improve. If you still aren't performing high enough, then they can sack you. If you've been there less than a year, then I think you can be sacked without being able to claim for unfair dismissal.

Just did a bit on employment contracts on my uni degree. Hopefully I'm not catastrophically wrong here.
