Like I said, it's not good for anyone when judges start to believe that they know better than our founding fathers and start to override the Constitution as it was originally intended.

The problem is that both the definitions of activism and what the founding fathers intended are based on opinion, as seen by the massive legal debates over centuries about those very points.

Nice try on the liberal talking points regarding "Bush's failed legacy" and yet you don't address why you called him the worst president ever. Why would I even bother to address each point above as facts don't matter to you.

I thought I'd help you along but it's apparent that even when the facts of a Jimmy Carter administration hit you squarely in the face, you choose to ignore them (as a typical liberal would).

wasn't carter lambasted for buying into the 'save the planet, cut greenhouse gasses' movement? hindsight is a wonderful thing, and if it is accurate that carter was environmentally accurate all those years ago, just who looks the fool now?

Soldiers died in more than one war - Bush's wars remember.
People homeless - Bush's government that forced banks to give mortgages out to people that could pay at unlawfully low interest rates for five years only when suddenly actual rates were then introduced meaning a whole lot of people suddenly couldn't afford to live in their homes - so now they live on the street. remember.

I didn't force you to vote Dubya in, that is a mistake you have to reconcile within yourself. And the first step towards healing is admitting there is a problem in the first place. pride before a fall and all that ;)

Naturally, you left out the part where Democrats in the House and Senate (Barney Frank, Chris Dodd, Chuck Schumer...those names ring a bell?) blocked attempted regulation of Fannie Mae and Freddie Mac. You can pin our current credit crisis squarely on the shoulders of the Democratic members of the House and Senate.

By the way smart guy, look up the Community Reinvestment Act (CRA) and tell me who were the main proponents of that? When the government (a Democratically led Congress I remind you) tells you as a bank that you must loan to lower income folks regardless of their ability to pay you back, anyone who's been in an Economics 101 class can tell you what the eventual outcome of that will be.

But hey, it's everyone's "right" to own a home right?

The fact that you're trying to pin that on President Bush tells me you have absolutely no clue of what you're talking about. Our economy is in the state it's in because of Bush? You're having a laugh. Yes, Bush "presided" over it. He didn't create it though. Fact.

Of and of course it was President Bush that told these mortgage companies to put people into mortgages that they had no business being in. Bush's fault.

Furthermore, if you doubt what I'm saying, use your fact checking prowess and pull up the well publicized video of one Barney Frank saying that they're nothing wrong with Fanny and Freddie and that we don't need to regulate them. It's all over the internet so certainly you've seen it. Funny that you didn't see it in the mainstream press over here though. Well not really but we both know how the MSM rolls over here.

As for people dying in wars. Wow. We lost more in the Gulf Wars than in World War II, the Korean War, the Vietnam War? The Civil War?

Just to add grist to the mill, no politician has ever force an individual/family to take out a mortgage. If people undertake such a huge financial commitment without investigating the full implications then I have absolutely no sympathy for them. There is a large victim culture at the moment where hardship is everyones fault but their own. Time to look in the mirror folks.

I'm being a bit devil's advocate here, but the justices are selected in just the same way that the president is elected. People elect representatives who then are presumed to act on their behalf.

The constitution provides that there shall be a supreme court.

Whether those members of the supreme court are activist or literalist or originalist or modernist is up to them, as was intended by the writers of the constitution. All of those interpretations of the constitution are opinion. Justices are appointed because their opinion is presumed to be more knowledgeable and informed.

I will have to disagree. In the US federal government, the 3 branches of powers (executive, judicial, & legislative) all have separate powers. We the People are represented by our elected officials - our congressmen, senators, president, etc. Judges don't represent the people, they represent the constitution. Their job is not to act on my behalf, they are not to be activist, not to be modernist, conservative, liberal, gay, straight, or elsewise. Their job is to review and adjudicate law in light of the constitution. Is it just an American symbol to have Lady Justice holding a scale while blindfolded?

It can vehimently be argued that the intent of the founding fathers was to have a living and evolving constitution. Many, if not most, were believers in state rights and desired limited federal govenment. If the constitution were to evolve through the judiciary, why would they make formal provisions for amendment the constitution? It is all too convenient for an entity to cede to itself powers that are not prescribed.
 
people shouldn't have had the opportunity to get into hock in such fashion, and the banks should have been less greedy, taking the money for 5 years then being only too happy to repossess.

turns out such wide scale repossession isn't quite the happy-clappy-world it had been made out to be.

everyones fault but the presidents. didn't someone write earlier about how they hoped Obama will wield (or not) his veto pen.

Under which presidents have more US soldiers died abroad compared to Dubya's duration as overlord?
What are the numbers of, homeless, and unemployed now in the US? - and when if ever have those levels been higher?
US manufacture reached a low of 38.9 recently, when was US manufacture so low in the past?
Did Obama actually campaign in New Orleans or is the fallout of the former presidents incompetency still prevalent amongst those that remember Katrina.
 
bye bye dubya, no president could be worse, so its a positive step regardless now.

hopefully obama can prove to be a good leader and president, but the weight of expectation could well prove his undoing, there are those expecting a quick fix, and problems that have taken so long in the making cannot be put right overnight.

No ones fault but there's if they take out loans they can't afford. That stands for individuals, companies and governments.

They could handle it though, until the fine print kicked in after five years and suddenly real interest rates were applied. Heaven knows how those people were sold such mortgages. Aren't there agencies setup to help and protect the public from such financial traps? but forget them, what were the banks actually thinking?
