Anything performance related in his contract may have been in the form of bonuses or yearly rises. He'd still be entitled to the payment of his normal salary...I think?

Martinez's team will go for the full contract amount and Everton's team will go much lower and then there will probably be a settlement which will see Everton pay out less and Martinez free to take any other paid work before the end of his original contract. If paying out the full term of the contract was the norm in these situations you'd see a lot more managers on "gardening leave".
Saw Bobby doing a phenomenal job as TV pundit on the Euro's in the USA last week. Surely a paid spot but likely thats not part of a non-compete clause. If he wants to work in the EPL again he will get lower compo. Also these things are often accrued in advance as part of a budget line to cover such eventualities. If the compo is in his contract then its a corporate liability that needs to be covered.

The fraud comes back and bite Everton after destroying this club in two years. Bill needs to take full responsibility for handling him a new five year contract after one good season. Moshiri shall sue Martinez back for not doing his job...I hope there is a clause written on the original contract stating Martinez had to achieve this or that or else he would be sacked with small compo.

Like Kenwright would have put such a clause in mate!

Well said hktoffee

Just refuse to pay him. What´s he gonna do? We could drag the litigation out for decades.

The clubs in the PL have signed up to a set protocol if Everton fail to negotiate in this instance it goes to a panel who will make a ruling there is no way Everton won't abide by that ruling. This will all be done and dusted way before the start of the season
