No mate. It hasn't been refuted it's been challenged as an underhand tactic (if indeed it was taped).

I know all this is difficult for you like. It cant be nice to see your icon come crashing down and that...

Who would have though at the time that there could have been possible misrepresentaion here eh? lol

Defamation no? which is a tad more serious then an underhand tactic. The underhanded tactic act hasnt been passed to make it a breach law for legal proceedings as far as i am aware and i would be.

One thing I think is very indicative and not good for the credence of some of the quotes is:

@peoplesgroup has vanished on twitter.

"This user does not exist."


Does the Guardian, Observer, Telegraph or any other reputable source just vanish if what they publish is correct and above board?

Come to think of it, only the likes of the News of the World has done that hasn't it?

Where does the defamation come in? They were highly complimentary about BK; he was the one who hung himself out to dry with his own words.

Anyway, the whole support base now knows for sure what Kewnright is. That's the main thing. All the rest is for amateur night legal eagle wannabes.
 
I think the battle ship has been sunk since yesterday mate, apparently some or possibly all of it is Jarg pending a possible legal action.

It would be a pity if this was a nail in the coffin for what could have been something i suppose positive to a degree - what were they thinking!

It's not going to be fake. It would have been taped so the legal action will be about that. It'll be accurate.

One thing that struck me about it is that Kenwright seems hopelessly out of touch with fans and... well... football in general. "Every club wants to be like Everton"... absolutely mental.

Overall though, I have no idea what Kenwright is worrying about. That transcript actually paints him in a positive light - as a desperate Evertonian, albeit deluded, who wants out.

Firstly you are doing exactly what you accuse others of: making assumptions based on flimsy evidence. The only 'claim' - nothing official - that I have seen is that the club might be considering legal action.

Defamation in this case (actually libel, not Tubey's slander) would depend if normal unbiased people thought that what they published affected the reputation of the club negatively in a concrete and commercial way, if it was wrong and if they published it
believing that what they published was correct (no 'absence of malice' as in the USA).

If the club (and this is as big an if as if they recorded the discussion secretly) is considering legal action, I would be interested whether they were rather considering action under data protection and privacy laws (after my time), especially with reference to EU protections.

Of course, just lawyering up has the effect of making any publication get very careful about what they publish, which may well be the intent here.
 
Tell me what bit was the interviewers actively defaming Bill Kenwright. I'd like to see this. Where are the false claims?

*waits*

Tell me the parts that arent made up, misrepresnted of false - we could go on all night. We know one thing for certain one party is gone to ground and the other has expressed a possible intent to take legal action.
