Times article, Burnley/Leeds threaten to sue Everton

The Premier League wont want this to carry on long, they dont want clubs pointing fingers at other clubs at all.

Take City for example, if they come for us, we defo go after City.
This will be either long-fingered or dismissed quickly. This is not even about Everton - who won't be relegated in a courtroom anyway. It's about not opening a can of worms that would bring the entire Premier League and its governance structure down.
 

Well, in summary; the concept of a commission is derived from the contract. It is functionally independent due to being staffed by professionals like lawyers who are bound to be impartial. The word "independent" has been used in the press by Leeds and Burnley to have a go at the Prem and suggest somehow they are not being fair- it's a term of art, it has no meaning. There is only a right to the commission as defined in the handbook. If the premier league doesn't agree to holding a commission as defined in the handbook, then you sue them. However if you go to the dispute resolution part of the contract ( X) you'll see it has an obligation to go to what is called an "arbitration" instead. This is effectively what you are talking about; it is fully independent of the premier league. However the arbitrator would not in reality ( I don't think) force the PL to enforce particular sanctions; it would only ask them to carry out its procedures better. This could mean investigating the accounts further ( if the arbitration hasn't already done so) and setting up the commission they have failed to set up which would then determine the correct sanction.

The words "independent commission" are words you have read in a press article, they don't mean anything in contract law.

I mean in the rulebook it is not labelled an independent commission.

Burnley and Leeds have asked for an independent commission. So they are not the same thing mate.

If the PL refuse to convene such a commission (which given no breaches have occurred would seem logical) they could look to sue. I doubt they would, as frankly theyd have a very weak case.

An arbitrator would have no power. They could make recommendations, and it's up to the PL whether it chose to override what it did previously.

Crucially, all of the above takes lots of time, and may mean some sort of warning in the future. It will not be resolved by tomorrow, or June, or the start of next season.

As you have stated though, it all really relates to the PL, and whether they were right to accept independently audited accounts by accounting professionals. I'd say they were fine in that regard. But if they were deemed wrong to do so, maybe whomever goes down, some years down the line, will have a case to a settlement.

In reality I doubt it. As no rule breaking has occurred.
 

Just think if they did would Everton have a case to sue the FA ?
Not sure, would probably be very messy and give the PL really bad headlines which is why I think if penalties are given out, they would apply next season (or later). Alternatively, if we finish above the bottom 3 by over 3 points (4 at the moment), who’s to say they don’t deduct 3 points and we still stay up? Burnley and Leeds are just looking for us to be deducted enough points for them to stay up, they have no interest in anything else which is why one of their names will probably disappear from these reports on Monday because they’re staying up anyway.
