6 + 2 Point Deductions

The whole point of P&S rules is to stop clubs from being utterly dependent on rich owners. We are the perfect example of why the League needs those rules.

If Moshiri calls in his loans or walks away then we instantly become insolvent and go into administration. Basically, a founder member of the League and a club with a storied history goes under because Moshiri is an idiot. If anything P&S rules need strengthening not weakening.

If there weren't P&S rules that actually to an extent reined in Moshiri's excesses we would be in an even worse situation. He would have just bought even more rubbish players and we would be in even more debt.
The issue isn't the rules, no one I know contests that. What it is, is the application of punishment for a breach of those rules, the adherence to a consistent approach.
AS far as I know there is no guidance on punishment, unlike the EFL, who do have a system. The PL are in reality 'making it up as they go along'. Their suggested punishment was -12 points, and as a consequence that means we could have overspent by a lot more and their 'punishment' wouldn't be that more excessive, and we would theoretically have a stronger squad and not have been fighting relegation.
No team has a contingency, it is measured by the depth of pockets as to how finances are managed. Retrospective punishment highlights inadequacies on the part of the organisation.

What evidence do you have that he was not paid for the duration of his contract? The report has a rather ambiguous ”dismissed” but no financial arrangements were detailed that I could see.

Given that no charges were ever filed, let alone a conviction, I’d have thought that Siggurdson would have had a strong legal case if his salary was not paid until his contract officially ended.
He was dismissed for breaching the terms of his contract not for committing a criminal act. So not being charged is neither here nor there.

He wasn’t suspended by the FA at all was he? We suspended him.
29. Everton had signed Player X in 2017. Player X had proved to be a star playerfor the club. In July 2021 Player X was arrested. The FA suspended PlayerX from all football activity, making it impossible for him to perform hiscontractual duties. On 23 August 2021 Everton dismissed Player X. Evertonsought advice on the possibility of suing Player X for breach of contract butelected not to do so.
30. By early 2022 it was clear to Everton that even allowing for the concessionsmade in the 13 August 2021 agreement meeting its PSR calculation targetwould be a challenge. The club’s performance on the pitch had fallen shortof what had been planned – with a reduction in merit fee of £2.1 million foreach final place in the league. Everton considered the loss of Player X to bea cause of the poor performance. Other players had suffered injuries. The12knowledge that Everton was facing PSR calculation challenges causedpotential purchasers for their players to drive a hard bargain. Evertonconsidered that the sale on 30 June 2022 of Mr Richarlison to TottenhamHotspur FC for the sum of £60 million, rather than the sum of £80 million thatit had budgeted to receive, to be directly attributable to its PSR calculationdifficulties.

The Premier League's new guidance was for six points for a breach and then 1 point for each £5m over the limit.

Twelve points is the EFL starting point before mitigating and aggravating factors are taken into consideration.

My recollection is while he was suspended he was on full pay, as per any normal contract, and, iirc his contract was run down and finished before the police decided not to prosecute. Sure he was on the wage list all the way through, sure some on here highlighted.

Which would be the reason to be angry/cynical about the punishment, many are quite rightly questioning the motivation.

Others are eating greggs
A new ex-pat shop with pies and sausage rolls has just opened up down the road for me so I've tested out this coping mechanism by purchasing 50 quids worth of pies and crisps.

Will let you know how I got on shortly but early signs are promising.

This. For an enterprise the size of the PL not to have any structure in place is ridiculous. It means that 'members' were unregulated as per how City are stringing them along.

In employment law, you can only be dismissed if the employer considers that you have broken the terms of your contract.
Yes I know that but to me it is very unclear what terms he was meant to have breached.

Similar to @magicjuan my assumption was that we told him not to report for his final season, ie dismissed him, but that we still paid him his contractual wage either as a bulk payment or in regular payments. That is where I also assumed the 10 million figure came in if we’d sued him for breach of contract - a claw back of salary (think he was on about 5milliom) and additional fees.

But that is all my speculation - you seemed to be stating things as fact and I wondered what your source was?

The trouble is that the report basically says…. “£10m? Unlucky, but you’ve got a £105m margin and you kept signing players and didn’t sell them…
So it’s not an excuse we accept “

paraphrasing obviously

but I can’t see that getting over turned

This is all Moshiri’s fault. He deserves bankrupcy.
