You are missing the point.Yes. At a time when the rules/calculation that landed us minus ten DIDN'T EXIST!
If Moshiri is involved you can never say thatNo chance
The Sheffield Wednesday case also says a sporting advantage is to be inferred, but that the points deduction is not intended to assess and reflect the sporting benefit of the breach. It says that would be likely impossible to quantify.Beyond reasonable doubt is for criminal cases. The burden of proof in this case will be the much lower 'balance of probabilities'. In essence, all they will have to decide is whether it was likely that Everton committing a serious breach of P&S rules affected the relegation battle.
Legal cases are usually decided by legal precedents. Given the Sheff Wed case, it is likely that they will find that a serious breach gave us a significant sporting advantage.
Very good article by Ian Herbert that.IAN HERBERT: The goalposts moved in Everton's case
IAN HERBERT: Everton were given the impression that the cost of interest on loans to build their new stadium would not be included in sustainability considerations, just like with Manchester City.www.dailymail.co.uk
Coherent and balanced from the Mail. The world's gone mad!
Changing the accounting rules on building stadia after the build has started hasn't had enough air time imo.
Look at the state of the teams we are aligned with there. The scum of the league.People really shouldn't be shocked we're on board with these lot.
Sure, Newcastle have way more to gain with the players in Saudi but given our lack of room to maneuver with transfers, we could use the 777 group to pick up players on loan from Vasco and Genoa that we otherwise couldn't take a punt on. Even Sevilla maybe.
I'd wager they don't.I've read the full article now. Mentions the appeal board having the option to increase the points deduction.
Hope its us doing all the snitching. I like Spurs but want us to throw everyones dirty laundry out there.
Luton will be winning the league at this rate.
Cash is fungible.Probably because it didn't happen.
The accounting rules haven't changed. What changed was that we published our accounts and a charge was registered with Companies House showing that the Rights and media funding loan was for working capital for day-to-day running and not for the Stadium.
The Stadium costs ARE permissible deductions and do not count towards our P&S losses.
We were trying to claim for interest on the commercial loans from Metro Bank and Rights and Media funding by pretending they were being used for the Stadium when they were not.
The Stadium was being funded by interest-free loans from Moshiri.
Neal Maupay comes back and we have to play Michael Keane. What punishment will we get in the end?
There's some Worms slithering out the tin that's just been opened.
100% agreeVery good article by Ian Herbert that.
I suggest everyone reads it.
It's got me thinking we should go for a full overturn of the ridiculous punishment they metered out on Friday.
Now rules are rules we all get that , but it falls flat when the governors of the rules can change them whenever & however they choose to forcefully push their political decisions.
Their judgement has lost all credibility now , let's not accept a "lesser" punishment, that almost looks like we should be grateful for it and the PL with their "indendent????" panel deemed justified.
Bring the whole corrupt system down , accept nothing less than FULL OVERTURN.
Spot on. He's written two good articles now on this.IAN HERBERT: The goalposts moved in Everton's case
