The decision isn't resting on much legal foundation dave - what are the criteria for it being up to twelve points, or ten points out of those twelve? What advantage did we get from overspending at that time? How does this overspending by less than £20 million compare with - for example - secret payments to the club from an owner, or an owner spending a billion pounds on transfer fees alone for two seasons when they are out of the Champions League?

As I said above the finding is one thing (and should really only be reassessed when City and Chelsea face the same process), but the deduction gives the PL nowhere to go for future cases; everything where PSR has been breached by more than £20 million must now result in a deduction greater than ten points. Every PSR case where the club blocks or obstructs the investigation must now result in a deduction greater than ten points.

If that is where the PL want to be then fine, but they really need to write that down so everyone understands it.

City already have been found guilty by UEFA and banned from European competition. Was overturned due to the allegations being time barred.

Theres already evidence to suggest City have broken rules. The premier league now accuse them of 115 breaches.

Everton were in breach of 1 rule which is due to opinions based on audited accounts.

But you know what they'll get? 10 points. Ours will get reduced on appeal...City's will stick. But 10 points to city is nothing.

Add to the fact City's breaches have been discussed by the government with Qatari officials is another reason why they'll get off lightly

Simple solution to all this would have been to have abided by the rules we signed up to.
The fair response would be to make a judgement on the first team that broke the rules and the first team that were charged.

Man City were charged in February why have they not had their hearing already?
 
The QC helping City in their case raised a complaint a while back that the KC leading the independent panel (Murray Rosen) is an Arsenal fan.

Bear that in mind when reading "it failed to discharge the duty of utmost good faith".
Not acting in good faith at the very least implies dishonesty. To suggest they do not allege dishonesty, but do believe there was a lack of good faith, seems an unusual argument to me.
 
The findings seem to suggest the club mislead the league on the issue of capitalised interest but I do not follow their argument as laid out.

I agree.

In my legal career misleading someone often denoted dishonesty.

No we don't.

We do know that these clubs will probably employ Trump's strategy of firing lawyers and hiring new ones. Then a new period of discovery begins. But this will cost them a small fortune to play this game. No-one is taking titles and cups away from them and we also know that it isn't in the Prem's interest to put harsh penalties on them. Ours isn't that harsh to be honest. We were all led to believe it was going to be 12 pts... it's 10 and on appeal it will get reduced. It's a token penalty really but some people want to get up in arms about it and claim it's a conspiracy against Everton. It's not, other clubs have seen points deductions in the past. It's done, we appeal, we get it reduced and we still stay up regardless. Bigger things to concern ourselves with... such as developing a better team.
 
Only takes one of them getting a new manager though and improving which they’ll all spin the wheel on eventually

Even if they roll the dice soon I wouldn't expect their form to improve too drastically. I think all of them will struggle to get to 30 points at best, regardless of what they do.
