6 + 2 Point Deductions

The problem with Burnham”s letter is its central point. That is that the premier league influenced the commissions decision. The problem being that the commission specifically said that they ignored the suggestions by the premier league.
Thats going to take some getting round in the appeal.
They said they ignored them then miraculously gave them the same punishment that was requested, that wouldn't stand up in a court of law.

Me, next time I see Andy at Goodison

What a guy.

That's the big threat.
Get the journos and hence the public on their side.

But, Burnham has cc'd his letters, (and I assume the PL response) to both the Sec of State for dept of media sport etc, and their shadow. As politicians, they will see what he is trying to do, and agree with him most likely. Regulation (Govt) is what the PL DONT want, Burnham is highlighting the need for it, if processes and boring admin stuff cant be conducted by the PL correctly.

The commission knew what they were doing when they said they ignored the PL's formula, because it's pretty clear the process at arriving at a formula was deeply flawed.

At the same time, 10 points is an unusual number to have arrived at independently and a crazy coincidence it happens to be the number arrived at by the formula. And the important point is they supplied no real alternative calculation to get to ten. So either they plucked a number out of thin air, which is in itself problematic, or they were in fact unduly influenced by a formula that shouldn't have been presented to them.

Don't worry they'll soon change the formula so that it suits City and Chelsea very nicely.

Barmy in it. You don't need to be a lawyer, barrister or KC or have a degree in law or economics. The average football fan or person on the street can tear holes in the report. Such as the war in Ukraine.

Yes all the additional elements should be successfully argued against by competent defence teams.

I'm expecting four points back.

Really the premier league should've just done a -6 with the original breach (had no idea that was the apparent automatic points loss if you exceed FFP) and left it at that with the caveat punishment could've been worse.
