Right, but whether they were restricted to or not, that's clearly the standard they are committing to using. So is the appeals body going to be willing to undo that standard?

I mean, they're now giving concrete info on the punishment for this sort of breach. As long as they subsequently continue to use that same standard for other clubs, it's going to be hard for us to argue against. Of course, whether they are consistent in applying the standard remains to be seen.

I actually agree with the finding there. Players are suspended all the time, players lose value. It's normal risk. There's also the argument that a single player of his ability would really change our financial performance? Seems unlikely to the extended it needed to be.

We admitted guilt and many of the mitigations were frankly dubious.
It's not the suspension that matters - it's the fact we didn't go after the player for breach of contract on welfare grounds. IF we had every right to (note IF), and that would improve our losses by £10m, then it sounds like a perfectly reasonable circumstance to put forward for consideration.

It's not the losing value that we would have a case on (as you say, that happens all the time, for many reasons), but the fact we decided not to sue the player when Everton make it sound like we could have.
