If I was advising EFC I would be tempted , if convicted ,to terminate his contract and then fight any unlawful dismissal / breach of contract claim.

The problem is Gibson might well win. I would hope that further bad publicity might put him off any action but often this is not a serious consideration for people like him.

Do you know how much over the legal limit he was Jazzy? Was the cyclist wearing any hi viz clothing? Did it happen on a open and clear stretch of road, or a blind junction? Why did Gibson pull in to the petrol station further down the road? Did he report the incident himself? Was he in shock when he hit the petrol pump?

That's a problem with the law, it should be toughened up.

Again, this is all personal experience. It's a callous and cowardly crime.

I think the charges in this case reflect that the injuries were very minor and it could have been a lot worse for them both.

All good points to which I do not know the answer.

However if he is convicted of all the offences that he is charged with and has had previous warnings for drinking ( I believe there was an incident in Dubai when he was rehabing ) and there is a gross misconduct / disrepute clause then there could be sufficient grounds to terminate the contract.

That is very different from saying that such action would be lawful and Gibson would have no right of redress

We've all been there mate, these cyclists pick on vulnerable drunk drivers, the only logical thing to do is to increase your speed and teach them that we won't be bullied anymore.

Yep, I was mowed down by a truck when I was out training on my bike (I used to race). The pain and the repairs to me and the bike and the time off work and the blood-soaked sheets in the bed for the next few days and the cost of treatment while the creep who did it got away with it. If Gibson is shown to be guilty, should be nailed to the wall.
