I don't know the terms of Gibson's contract and gladly accept I may be wrong in this instance however some years ago I was given a model, typical Form of Contract supposedly used as the basis for negotiation for player's contracts. It states that a player's contract may be terminated immediately and without notice if the player is guilty of serious misconduct which in the Club's opinion may injure the reputation of the club.

It also makes mention of "persistent breach" ... and I seem to recall Gibson's been associated with drink related, bawdy behaviour before.

Talk of rehabilitation, seeking help etc are normally exactly that .. talk. Most employers in this situation normally want to get rid of the problem without too much fuss.

Everton have got to be very careful too given past (aforementioned) 'indiscretions', we don't want to be seen as a soft touch amongst players or encourage similar behaviour amongst the younger millionaires.

My hope would be that the club release him from his contract but send him to rehab. They don't have to do that of course, but I think it's the right thing to do in this instance. I don't think he should play for us again, but if the club at least helps him on the right path to getting his life sorted out, I think some good can come from a terrible situation

The club would be well within their rights to cast him aside at this stage, but I like to think Everton is better than that
Yeah, can't see them dropping him. No doubt they'll offer help and let him go next year..

I think the alleged charges are quite minor on the scale really, I doubt he would receive any significant sentence if found guilty.
The few footballers that I can think off who have received custodial sentences for driving related incidents have found clubs again after serving them, so it shows clubs are willing to employ them even if they are notorious.

That's a problem with the law, it should be toughened up.

Again, this is all personal experience. It's a callous and cowardly crime.
 
If the clause that you referred to in your opening paragraph is replicated in his contract then this would give grounds for a repudiation / termination of the contract but as I indicated previously these clauses are narrowly interpreted by the courts.
 

No, just don't rip his current one up.
If I was advising EFC I would be tempted , if convicted ,to terminate his contract and then fight any unlawful dismissal / breach of contract claim.

The problem is Gibson might well win. I would hope that further bad publicity might put him off any action but often this is not a serious consideration for people like him.

When you look through the media at what some of the stuff footballers are supposed to get up to you'd think we've got a squad of altar boys, let's not blow this out of proportion until all the facts are presented properly.
