Lawyers acting for the former Chelsea team doctor Eva Carneiro have served notice on the club that she intends to bring a claim for constructive dismissal, having failed as yet to agree a severance package following her departure last month.

Legal papers are understood to have been served on the Premier League champions earlier this week as time in the three-month window permitted for claimants to lodge any complaint ticked down towards its deadline of 8 November. The papers will trigger an employment tribunal unless an out-of-court settlement can be agreed before a hearing takes place. Such tribunals are conducted in public and could be embarrassing for either defendant or claimant, meaning a compromise is usually struck beforehand.

José Mourinho is to be the subject of an individual legal claim from the former Chelsea team doctor Eva Carneiro in addition to the action she is bringing against the club for constructive dismissal.

Press Association Sport understands legal papers will be served on Mourinho this week as part of separate but connected claims against him and the club. It means Mourinho will have to appear in person at an employment tribunal unless the case is settled out of court. Under employment law, an individual can be personally liable for damages if victimisation or discrimination can be proved.

The claim against Mourinho will be on the basis he was instrumental in the actions against Carneiro in having her dropped from first-team duties and effectively demoted.

Eva Carneiro’s case for constructive dismissal against Chelsea will have its first tribunal hearing on Wednesday.

The preliminary hearing will take place at the London South Employment Tribunal in Croydon and is expected to be in private before an employment judge.

The hearing will fix the timetable for the case and deal with witness statements and disclosure of documents – including texts and emails – by each side, as well as any legal procedural disputes that exist between the two parties.

A date for a full hearing could be fixed for some time in June but there may be another preliminary hearing arranged before that takes place. The parties may also agree to a settlement before the case is heard.

Chelsea filed their defence last month. The former Chelsea team doctor also has a separate personal legal action against the club’s former manager José Mourinho, who left in December, for alleged victimisation and discrimination.

The tribunal attended by Eva Carneiro and Chelsea on Monday broke up after six hours, with neither the former Chelsea team doctor nor the club commenting on whether a settlement was reached. If the parties failed to reach an agreement the matter will proceed to an employment tribunal which would be heard in public on 6 June.

Carneiro is claiming constructive dismissal against Chelsea and has a separate personal legal action against the former manager José Mourinho, who left the club in December, for alleged victimisation and discrimination. She arrived for a private employment tribunal in Croydon on Monday along with her legal team and her husband, the polar explorer Jason De Carteret.

Her barrister, Mary O’Rourke QC, told ITV News before the tribunal began: “We’re not expecting a resolution today. The two sides are so far apart financially. And we want Mr Mourinho to make a public apology.” ITV said Carneiro was claiming “substantial damages”.

Mourinho will be absolutely cackling it if this goes to a public hearing.
 
I can't see how Chelsea or Mourinho have a defence on this one. Bizarre that they're even fighting it.

Depends on what their official instructions were. If it was follow the advice of the Ref, then they are in the crap, if it was follow the advice of the Manager then they are not.......depends on what the rules were within Chelsea.......she is still cute though..........
