I'm going to make my own official Ebepton crest, to solve all our problems.

In all seriousness, I've just decided not to buy next seasons kit and most Everton merchandise I'd usually be interested in, solely because the funds would fund the salary of the tools who "police" Everton forums for this nonsense.

Not even joking, deffo not doing it.
 

Legal minds would know better than I, but isnt it the case that if something subject to copyright is being generally used freely by the public and without sanction by the copyright holder then the copyright holder cannot enforce any claim of copyright on it? If so, they probably have no choice.

The club's lawyers cannot people stop making comment or discussing news stories.

They also cannot stop anyone linking news stories as long as not represented in full, with acknowledgement of source.

I can understand the club logo due to it being represented alongside - on occasion questionable views... So not displaying it is probably acceptable by all...

Not a court in the land will stop people discussing football related stories. Provided the stories aren't reproduced in entirety and without link to source

Article 10 of European convention on Human Rights , incorporated into UK law under the Human Rights Act.

Yes, but my point was more that if they show (by letters like the one GOT recieved) that they do not allow free and unrestricted use of the crest then they can go after people who actually are abusing the copyright - fake merchandisers, tat-peddlers, people who photoshop Kenwrong etc etc

If its a registered trademark sure. Its as much as the resource they put in to protect it.

However,

I for one OBJECT to them trying to infringe on our civil rights. Discussing news stories - trying to stop that that is actually illegal !!


We've discussed the club, the team and so on that we are putting money into every week.

And for one thing our discussing news - is protected in law.


Not for some jumped up lawyer to tell us otherwise.

THIS IS TOO MUCH.

In seriousness though, all this copyright stuff in the world is going too far sometimes...and us much as England claims it's a 'free speech' country - it's really not in many terms. :/

No. As a work of art, and where you've drawn it from life, no.

Its classed fair use, especially as you are not economically impacting the trademark claim, and all of yours have been life drawings.

Also: There is no copyright in an individual’s likeness, e.g. in his or her natural facial features



If you make a parody of the team or turn them into cartoons, provided you don't use the Trademark, actual names or anything else you're also covered.


So don't worry about it.

at least in american law, fair use only applies so long as you do not turn a profit. so if i use it in my post as part of some kind of expression, as long as i'm not making money off of it, its okay. i'm pretty sure fair use doctrine is fairly consistent internationally.

but seriously, what is the rule on me posting a picture on my officially licensed everton kit with my macbook camera? i bought the kit, why shouldn't i be able to post the crest?
