at least in american law, fair use only applies so long as you do not turn a profit. so if i use it in my post as part of some kind of expression, as long as i'm not making money off of it, its okay. i'm pretty sure fair use doctrine is fairly consistent internationally.

but seriously, what is the rule on me posting a picture on my officially licensed everton kit with my macbook camera? i bought the kit, why shouldn't i be able to post the crest?

Remember the site is governed under English law. And whilst fair use is very similar under most common law jurisdictions it is not the same in all.
 
I'm only going to say this.

If the club think they can in any way stop discussion of news, what is going on or the making of commentary including matches

they are wrong. For reason's already described.


Not particularly bothered about the club crest. Which is trademarked.



But if they think they can stop match action photos being published if the source and links are given most certainly constituted as fair use, in this case, then they ( the club ) are wrong.

And I view that as an attempt to limit our discussion of news and passing commentary on club affairs.


Our right to do that is protected under UK law.

So the club's lawyers can take a running jump!

This protection in the US would be under the First Amendment of the US constitution.

In the EU it would be national legislation implementing Article 10 of the European Convention of Human Rights. In the UK's case the Human Rights Act.




Or are EFC seriously thinking they can censor any discussion of matches and critique of the club?

No, despite what they may claim the lawyers have no such power.

They have rights to the club crest, the fixture list in entirety, but they cannot stop commentary, discussion or news reporting.

good point, if only they would put this attention to detail towards things like player contracts and merchandise licensing that actually matters.
 
wonder how this would stand up, as there is numourous diffrent types of everton crests, they could copyright the current one used by the club, but any others would be a minefield, as people who designed them could say the club are stealing there idea ect and counter sue the club
 
Everton are PR geniuses. The relations between the fans and the board are at a real low, so they thought this would be the oil to pour on troubled waters. Good job I only support Everton Chile, Ebepton, Clive Everton, Brett Emerton and Everton mints, and AM IN NO WAY CORRELATED TO EVERTONFC MEGACORP SPORTS ENTERTAINMENT AND GOODISON PLUTONIUM DERIVATIVES CONGLOMERATE.
