Everton FC in battle with village farm shop over its name

Look, the Everton is very similar to the font that Everton use on their official stuff. It is at least three times the height of 'Farm Shop' which is in much fainter type underneath. The lady who is complaining wasn't actually contacted by the club and told to stop using it - she actually wanted to trademark the way she was using Everton so she was the one that started taking legal steps and, quite correctly, whoever the club pay to manage this stepped in to protect their rights.

It is just a business thing. The woman was either commercially incompetent or chancing her arm - either way the club and their legal advisors appear to have been more than fair in this case. (And, like GrandOldTeam, I speak as someone who has been on the receiving end of legal threats for copyright infringement and they are usually a lot nastier than that.)

They're an independent charity mate.

I have heard that but the club like to attach themselves to the Charity and portray a family friendly community image, which I think this action goes against really as it seems like a family shop rather than anything too commercial. I wasn't having a dig at the Charity obviously, just think it's a bit over the top issuing them with legal threats.
 
What a bleeding stupid thing for our club to get upset over. They were always on a loser looking at the historical facts. What they should have done is paid for the word Everton to be in bue not black. Heaven help us from some idiot nomarks in the club.
 
If she's tried to copyright Everton and we've rightly told her where to go, I have absolutely no problem with the actions of the club.
Particularly seeing as we offered a paid for alternative.
While the club doesn't come out looking shiny by way of the demonization it's gone the via the media, it seems to me to have been the right action to take.
 

Embarrassing from the club. You'd expect this from the other lot.

On my travels I've stopped at a place in Australia called Everton Valley and they produce great wine with Everton featuring prominently on the label Go get'em Elstone you prize Trump, you...

Oh and while you're chasing lunacy there's a posh new housing estate called Everton Park in Southern California with a great big sign proudly saying Everton. Why don't you chase the developers and residents too Roberta???
 
Legal people need to be set alight. All of them.

Thanks mate. I'll think of that the next time I'm reading a thank you letter from a client who I helped win custody of his child, or the next 70 year old dementia patient I help get funding for long term care.

The next time I start to feel warm inside because I've finalized the adoption of a neglected child or appear in court to speak in defense of somebody wrongfully charged, I'll remember that me and my kind are scum who should all be set on fire.

Football giants Everton have taken legal action against a farm shop over the use of its name - even though it is in a village called Everton.

Owner Daniela Troop, 46, was shocked to receive a legal letter from the Merseyside club objecting to her trademark.

She has a shop in the village of Everton, near Doncaster, South Yorkshire, which can trace its history to the Domesday Book and her family has farmed the area since 1440.

But she has now found herself in a row with The Toffees, who have objected to the prominence of the word Everton in her shop logo.

The club have told her she can continue calling herself Everton Farm Shop, as long as she changes the size and font of her sign.

Ms Troop, a mother of three, hit back with her own legal challenge and there is still no final result to the row.

She said: "When I was told about the objection, I cried. It was so upsetting and actually quite scary to be up against such a wealthy club.

"The Troop family has farmed Everton land for generations - we are very proud of our village and its name."

The Premiership club, founded in 1878, have offered Ms Troop a settlement where she can continue to call herself Everton Farm Shop as long as all the words are in the same size and font.

She has yet to accept their offer and added: "The only reason Everton has backed down is because we counter-actioned them."

Ms Troop added: "The name Everton, in terms of our village, is derived from Anglo Saxon and translates as Wild Boar Farm. We have begun farming organic pigs and I think it would be great for Everton FC to taste some real Everton."

They initially called it R Troop and Sons, but decided to re-brand in the spring and have already picked up two awards for their produce at the Great Taste 2015 awards.

Helped by their children Joseph, 20, Romy, 18, and 16-year-old Angus, the family farm cows, sheep, pigs and crops.

Ms Troop said: "Our land is of conservation grade, so really good for the animals. When they are on top quality grazing land, it makes such a difference to the taste.

"There is so much history in Idle Valley. I think Everton FC should come and take a look for themselves - I think they would like it."

Everton Football Club have been contacted for comment.

somebody somewhere must've signed off on this and Christmas or no should be given a festively decorated P45.
Or at the minimum a boot with tinsel on it applied to the backside until the kickers leg gets tired.

you ought to see by me, you can't move for Everton businesses, Glass, car repairs, garden supplies, hair dressers.
all strangely enough in a district of Brisbane call Everton Park

One thing about this, right or wrong from the club, i know for sure next time I'm around that way ill be popping in to buy something, some good publicity there for her.
 
You would think that, as the ones paying the bills, the club would request the legal firm at least consult with it first before launching such actions. The legal firm and PR department ought to mull over the ramifications; instead we have something akin to owning a pitbull to protect you from bigger or more viscious dogs that might threaten you, but rather than keeping it leashed, you let it run free and it runs away to the next county and kills a Pomeranian.
