Whatever percentage they went over the cap, they should lose that percentage of points from last season. As in both drivers lose up to 5% of their points. They should also be limited for next season in either terms of budget or wind tunnel/testing time. A fine will do f-all as they already have the advantage and enough money to take any fine without blinking.
 
The overspend we are taking about is HUGE. In F1 tenths of a percent can make a difference.

My proposal would be: work out the average budget per race. Work out the overspend x2 and how many races this is equivilent to, then remove their best results from that number of races.

135m budget across 22 races = $6.136m/race

A team that is 7m over budget, times it by 2 = $14m which is 2.28 Grands Prix worth of overspend, which rounded up is 3 full races

Punishment should be they have their 3 best race results nullified, all drivers and team points. Best result in this case being whatever weekends gave their their best points hauls.

Totally thrown out the championships is not realistic, but look at football as an example. Teams are punished punitively if they are found to have breached financial rules. Derby County docked 12 points for entering administration - basically an admission they've been financially mismanaged. Personally I think my proposal above is a pretty fair one; not throwing them out, but harsh enough to act as a firm deterrent, and goes up in proportion to the degree of overspend.

I would also add that Team Principle and CFO should also be barred for involvement in the sport for 3-5 years if found to have breached.

So long as its a total ban from the sport.

Sky is bad enough without Horner joining the team for the next few years.
