@theesk is going to give detailed analysis

I find his analysis insightful

I am also waiting on that and other commentary before I start screaming "ITS UNFAIR"

What I do know however is Bill Kenwright is the worst thing to ever happen to Everton Football Club

He's a disgrace. He has been asked to resign. But refused. His reasons are ridiculous. You get the idea of them below. Delusional. Detest him utterly

I think our only get out is that we have apparently been dealing with the PL for sometime in regards to our finances, so are the PL just posturing before this independent regulator comes in to force? Either way, we won’t be in this division soon, the club has completely hamstrung itself with its reckless spending over the last 6 years.
I dont accept that, tbh.

I think we're more likely than not to get out of this relegation scrap and that any punishment we receive wont hand us an impossible task in terms of survival next season.

There's lot of people losing their heads at the minute - helped along by mischevious media reports. But if we survive this season I think we'll be ok.

They can't until the processes they have signed up for have been exhausted. We are 1/20th of the company that makes the rules we signed up to.

There are examples of businesses suing professional bodies they form part of. It happens.

I have no idea if it happens this time. But it theoretically could happen.

To say that Kenwright and DBB are a disgrace and implicated in this referral is a given.

But the process looks wonky to me. EFC seem to have a good case to put together in mitigation what with the pandemic, the block on Russian-regime connected investment, the once in a century stadium construction costs and the damage done to tv revenues.

Just because this club have a hierarchy that should be in the bin doesn't persuade me that the PL have made the right decision to refer Everton.
Firstly the Stadium construction costs are exempt.

Secondly, Pandemic costs are exempt.

Thirdly, we got the USM money upfront so they have no effect on the accounts.

It's not "just cause"

It's "cause of action"

Yes. And that is not dictated by you. They have the option to decide what they feel that is.

But honestly mate, you are just telling me different ways you agree with what I said initially. I know that teams can sue in certain circumstances. That's why I pointed it out to you who initially had some strange position they couldnt.

We can't launch a legal action.

We have absolutely no grounds.
Really ?

As there is no punishment metered out as of yet there is no recourse from either side.

In the event there is, there are a few mitigating circumstances that would prompt legal action.

Assurances from the Prem we were compliant.Plus notifying the rest of the league there is no case to answer.
Even allowing the club to bring in transfers.
Constant dialogue with the Prem throughout this period.
The obvious Covid connection.
The unforseen Russian invasion of Ukraine and subsequent withdrawal of the clubs major sponsor.
Continual compliance over the last few seasons to meet the rules.

Legally wise nowhere near as clear cut as you think.
