Everton: 'Negligent' Premier League now under legal threat as rival appears to back Toffees FFP defence, all 19 clubs unhappy​

The Premier League itself is now under threat of legal action over its handling of Everton amid “widespread unhappiness” from all 19 clubs, according to the Daily Mail.

The Mail had already reported (16 May) that Leeds United, Nottingham Forest, Leicester, Burnley and Southampton had lodged legal papers with the intention of any three relegated sides to seek £100million each in compensation from the Toffees, and the Clarets possibly mounting a separate claim.
I don’t get it…how can three of them be ready to mount a legal challenge against us subject to PL ruling only on the other hand be ready to pursue a ‘class action’ over he PL handling of our case? I appreciate probably a different journalist, but something is amiss here!!!
 
The other lot (i.e.) relegation threatened clubs are talking about suing us for £300 mill.

Everton could face a £300million legal challenge from rival clubs if they avoid relegation from the Premier League this season.

The Toffees were charged by the Premier League with an alleged breach of financial fair play rules in March. The club have posted staggering losses of £372m over the past three years, in excess of the £105m limit.

Everton have denied any wrongdoing - they have also not been found guilty of breaking any rules - and vowed to “strongly contest” the charge, which could carry a substantial points deduction if proven. But that punishment isn’t the only possible outcome, with Southampton, Leicester, Leeds, Nottingham Forest and Burnley all eager to pursue compensation as well.

The Daily Mail reports that the five angry clubs applied for Everton’s disciplinary hearing to be fast-tracked so that any punishment dished out would be applied to the current season. The commission looking into the allegations rejected this request, prompting the clubs to lodge legal papers making them party to the dispute.

While there are five clubs involved, the £300m claim would be brought by the two clubs who are relegated alongside Southampton, were Everton to avoid the drop. They believe they would be entitled to £100m each, which is an estimate of the loss of Premier League income for one season after the deduction of parachute payments.

Despite winning the Championship to return to the top flight at the first time of asking, Burnley due to their annoyance over Everton’s finances from last season. Burnley’s relegation last season meant they missed out on valuable TV money and the drop meant they were forced to repay a £65m loan early.

They do not attribute their relegation to their poor play, oh no It is all down to Everton surviving by getting more points than them whish was unfair !!!!!!!!!
As far as a legal challenge against everton for loss of income….. as far as I can see the clubs involved just like Everton have a contract with the premier league NOT with each other. It’s for the premier league to enforce their own rules not the clubs, if a club is not sticking to the rules, whichever they may be ffp or anything else it’s for the premier league to investigate and punish. I can’t see how the clubs involved can expect double jeopardy and expect a premier league punishment and also money from Everton in a separate action

the clubs should be looking at the premier league the Manchester City situation re ffp has been going for years and will have a massive bearing on Everton’s case, also as we are led to believe the premier league has been all over Everton’s accounts for 18-24 months oking all expenditure (remember Benitez and the summer of £400,000 transfer dealing!) if anything the premier league are in breach of their own rules allowing us to spend if we consulted with them closely and they did nothing

The Times then reported (17 May) those clubs had “distanced themselves” from that report, but the Mail has now gone further, with apparently-widespread discontent within the top flight at the league’s handling of Everton expenditure, after having worked closely with the club to control it – Everton insist they have not breached FFP rules.

The aforementioned sides are therefore considering a “parallel claim” to any they pursue against Everton, for damages from the Premier League.

And a source from one appeared to back the Toffees’ stance, telling Mail Sport: “It’s clear that the Premier League have been ineffective or negligent with regards to enforcing their own rules.

“Everton’s defence against the charges is essentially that the Premier League approved all their expenditure, which appears to be the case.

“The Premier League certainly had advance warning of Everton’s planned expenditure before they submitted their 2021/22 accounts in March, yet they stood back and allowed them to keep spending.”

Mess of their own making?

With nothing proven against Everton until the independent commission hearing, and the club insistent they are above board anyway, this may all go away in the coming months.

But there is clearly a great deal of upset to go round, and if the league is in the firing line yet they supposedly permitted the Toffees’ spending, what that means for the charge they have slapped on the club is hard to fathom.

For Everton’s part, their stance appears to be clear in that they believe their massive losses – over £300million in the past two rolling three-year windows – are permitted due to Covid-19 disruption and other allowable spending including the stadium development, and that the league has been supervising their moves since then.

Based on the quotes from one of the aggrieved rival clubs the latter part of that looks to be accepted, so the threat of legal action apparently pointing in multiple directions may be an attempt to cover all bases for whatever the outcome of the hearing is, which could still be months away.

It was a surprise when the Premier League charged Everton on 24 March, with it widely known they had been working with the club on spending a year ago.

While signings were made in the summer, none arrived in January – with Sean Dyche feeling the effects of that on the pitch – and two stars were sold in that time in Richarlison and Anthony Gordon.

Though the entire situation is far from happy for Everton, if anything it sounds like the most recent report makes things much more uncomfortable for the league.

But until the relegation battle is settled and the hearing eventually announces its finding every accusation and counter-accusation is primarily going to be based on supposition.

Somebody should sue that paper...so they are talking on behalf of the 19 premier league clubs...interesting. I am sure city can't wait for us to get punished as it is obvious that any penalty we end up getting, City will get another one probably 10 times worst as they have many seasons with ffp issues...let's get real. This guy has an agenda against us. Most clubs in the league can care less with the exception of those impacted by relegation.

They cannot afford to take on City...they like their money too much! But, likewise, if they pursue us then we can drag in just about every other club including City. Let's face it, there is an argument that those teams who are, allegedly, creating this storm lost points against teams who are also breaching FFP. It is just NOT an Everton thing ('that')

It seems to be a case of, while we’re on the gravy train anything goes, but once there is a chance it ends it’s everybody’s fault but ours!
it made me laugh Forests name was listed with the 400 signings they made this season! they must be very worried about going down as the EFL are much more effective than the premier league in dealing with this stuff
 
Both the reports of the grass clubs stampeding the PL demanding a quick decision and the story about Everton being backed up by some PL clubs over the way the club have been unfairly commissioned are pure BS.

None of that has taken place. It's pure hackery. All concocted in the mind of a chimpanzee with a keyboard.

Surely on coming up they would have inserted relegation clauses but….
the squad forest got promotion with was made up of loans and 1 year deals (something that seems to be becoming the norm unfortunately in the lower league) but they are apparently paying Lingard £10million for the season! A huge chunk of the clubs usual annual income, Gibs white is on a 5 year deal and could cost up to £42 million!! they’ll be absolutely buggered if they go down
 

What a surprise all this comes up, again, before 2 of the most important games in our recent history. These stories are planted to take a mental affect on players, fans and club. Same as when the international break kicked in and straight away this FFP breach got reported. It’s hilarious. Be great if we are found innocent because the FA messed up our accounts.

net -£140 million in the summer and net -£20 million in January
against a turnover of approx £30 million in the championship! I know the jump up to the premier league is a huge boost to finances but if they go down they’ll be paying for a year in the sun for ages

Just say Everton are found in breach of ffp and Leeds, Leicester and Southampton are relegated and try sue Everton each for 100 million.
How would that work as Everton can only impact on 1 relegation place which I would imagine means the team that finishes 18th would be the only club that could legitimately sue, not all 3.
