It is not a Court. The vast majority of the act relates to Criminal proceedings - have a look at schedule 1.

Everton are subject to an independent commission created by contractual agreement between football teams. Nothing to do with this act.

Any leaks does not mean that Natural Justice has been breached. If the breach comes directly from the commission and they have made a decision before hearing from both parties, that may make the process unfair. No evidence of this.

I never said it was a court - it is a quasi-judicial or 'other proceeding'. Schedule 1.1 defines what criminal and appellate proceedings are, but the Schedule clearly includes "Other Proceedings".

Other proceedings at first instance​

12 Proceedings other than criminal proceedings and appellate proceedings are active from the time when arrangements for the hearing are made or, if no such arrangements are previously made, from the time the hearing begins, until the proceedings are disposed of or discontinued or withdrawn; and for the purposes of this paragraph any motion or application made in or for the purposes of any proceedings, and any pre-trial review in the county court, is to be treated as a distinct proceeding.



Even if it is argued that this Act does not apply to the Commission's deliberations, it is still bound by the Rule of Natural Justice and all parties are bound to respect the sub judice rule, particularly participating parties, and anyone who has the ability to publish material that might be seen to prejudice nthe proceedings.
 
Imho the message is the PL are expecting a punishment of anything up to 12 points and it has been sensationalised from there.

If the PL have been signing off our accounts as reported then there needs to be a hidden smoking gun that no one was aware of to push for the maximum. As they were signing off on what we could and couldn't spend they could have said no you are going to be in breach and we'll push for a 12 point deduction. At that stage we could have punted Pickford, not brought in Onana etc. I know ultimately it is our responsibility but if you work with the authorities you expect some leeway.
Everton and the PL hierarchy: we're like crap to a blanket - stuck with each other on this.

There's going to be a paper trail as long as your arm between EFC and the PL that underlines how much the PL are part of Everton's attempts to get back into line.
 


Awful lot of folk in here vastly overestimating how much fans of other teams care about Everton football club.

…most will want to see us drop but I think the likes of Man City and Chelsea fans are almost as keen as us to see Everton avoid a points deduction.

I still wouldn’t be surprised if this is because Man Utd and RS are the ‘cash cows’ of the TV companies.
