I think the contention here is that:

Normally aggravated circumstances still only relate to the same crime and sentencing. For example burglary, becomes aggravated by use of weapon etc.

If he is being charged with abusive language then use of racial abuse would become aggravated.

However, if he is being charged with a single charge of racial abuse (which would hold a higher penalty) then it supercedes the other.

Please, please, please, show me 1 example of a player being charged with saying mean words to another player, without any racial abuse in the incident.

People will cite McFadden but that was for calling the Referee a cheat. Completely different.

I dunno what game other people watch, but the football I watch, every single player gives it beans every game, back and forth, hell most weeks it goes way beyond words, but Dave thinks shiny teeth should get done for being mean!!!

He is never going to get a ban for saying puta at someone. Every single week hundreds of players would be sent off.

Oh and I guarantee if Firmino was charged with it, you'd have hoards of RS basement dwellers trawling through Everton footage each week pushing for bans. Laughable.
 
A dark skinned young man got abused because his skin is dark. He reported it. This happened on the 5th January. We know nothing about what is going on and it is now the 14th February.

It happened under a spot light on national television at a well publicised sporting event, with it being shown widely outside of this country. The organisation he reported it to have a clear mandate to investigate this as a priority, as they have done in a subsequent similar circumstance (Bong-Rodriguez). No media seems to be in the slightest interested in finding out what is happening. The abused man has had his past muck raked and seemingly is under scrutiny over comments he made as a 15 year old. The abuser is gaining plaudits and having a significant impact to the benefit of his employers that may not have happened if there had been a speedier resolution to any investigation.

Take out the fact that this was a sporting event, and I bet this story is so sickly common that even a middle aged white guy like me can understand that it smacks of systemic racism and old boys clubs being able to pull a few strings to make things go away.

This affair will eventually play out, and I for one will remember how the FA in 2018, couldn't or wouldn't conduct an investigation into an act of alleged racism in a satisfactory manner. If it's word against word - then say that. If there's no video evidence - then say it. But the longer this drags on, the longer it smacks of cover up and conspiracy and the less I trust the FA.

If the referee had put it in his report and if anybody had come forward and actually backed up Holgate's claim, then there might be a case to answer. At present though, how is anybody supposed to take this forward without any real evidence?

The consensus seems to be that he insulted him in Portugese and also that his skin colour was not used. He actually called him a "crazy son of a bitch"? or something along those lines.

If there is clear evidence that Holgate was racially abused then it needs dealing with, as of yet though that is still very unclear.
 
If I was called a "crazy son of a bitch" I would probably laugh. If I was black and was called if, I think, I would also just laugh. Seeing as Firmino likely doesn't know Holgate's mother I am sure he wouldn't take it personally. I don't see what race has to do with being called a son of a bitch. That said, maybe something else was said. Who knows - we certainly don't.

it may "seem to be the consensus", but as I tried, in vain I may add, to explain to a RS work colleague only yday, "you and the rest of your 'fans' cannot see through peoples heads, so get down off your skyscraper of a horse"

I too believe the longer it goes on the more suss it looks on the FA's part, I think they are desperate to dismiss it with no case to answer but are scouring the earth for any possibility of evidence it did happen so it doesn't blow up in their faces

The referee has included the accusation in his report. Therefore the FA have to answer the accusation by either saying there is no evidence to support it and dismissing it or charging Firmino. Doing nothing shouldn’t be an option but that is looking more and more likely the longer this goes on. There can only be so much evidence to go through, player testimony, referee testimony, video evidence etc. There should have been a communication from the FA by now. Until they do, it sends out the message that the FA ignores accusations of racism in football.
