No, he isn't, because the ref seen it and chose not to card him.Holgate - bang to rights. Did he not push someone over advertising boards, potentially injuring a player purposely? I'm not condoning alleged racial comments, just playing devils advocate. The whole scenario was in breach of Rules of the Football Association: E CONDUCT-GENERAL BEHAVIOUR 3 (1).
No. His word against Evra's.But wasn't suarez seen on camera saying negerito or whatever it was several times, ie they have hard factual evidence, in this case isn't it just Holgates word vs firminos? in which case of course it's going to take longer
Even if your take on things in correct then why the delay, why no announcement? In fact if it is this cut and dry why didn't the FA state there was no case to answer weeks ago? This is all very paranoid based opinion without any real substance IMO.
If the referee had put it in his report and if anybody had come forward and actually backed up Holgate's claim, then there might be a case to answer. At present though, how is anybody supposed to take this forward without any real evidence?
The consensus seems to be that he insulted him in Portugese and also that his skin colour was not used. He actually called him a "crazy son of a bitch"? or something along those lines.
If there is clear evidence that Holgate was racially abused then it needs dealing with, as of yet though that is still very unclear.
I'm afraid I am in agreement. United never backed down with Suarez, they made a deal out of it. They made it so that action had to be taken and the path of righteousness was taken. We should be doing the same for our man. They dont ask also because the press conferences are stage managed and the club dont want to upset Liverpool. There, I've said it: EFC hiding away from the issue because they wont or cant stand up to that shower and annoy them.
Allardyce doesn't want to know, the club dont want to know. Holgate has been left hanging out to dry.I'm afraid I am in agreement. United never backed down with Suarez, they made a deal out of it. No, he isn't, because the ref seen it and chose not to card him.
Let me play devil's advocate and say that there is still some part of the investigation outstanding, and that it might take some considerable time to analyse and draw a conclusion. Then why not say this? I know better than to put down a deadline that can not be guaranteed, but the absence of anything from the FA, or Everton is abysmal.Allardyce doesn't want to know, the club dont want to know. Holgate has been left hanging out to dry.
40 days - that surely is setting records over an investigation?
But the ref witnessed the incident and chose not to act. If he'd not seen it then Holgate retrospectively could have been disciplined.According to the extract you posted, it was violent conduct regardless of whether the ref chose to card him or not. Pushing someone over a hoarding isn't violent? Of course it is.

He certainly used physical force with the intention to hurt him.

No. His word against Evra's.
"Evra made his claims immediately after the match and was quoted as telling French TV station Canal Plus: "There are cameras, you can see [Suarez] say a certain word to me at least 10 times."
i do remember seeing this and there was definitely more than one clip of Suarez saying it, so like i said that automatically is proof, as of yet there is no proof against firminho just holgates word, hence why it is taking longer
