Because it's not beyond doubt that he murdered somebody. Hence the trial.

Bail is set because he doesn't meet any of the criteria which would be needed to deny bail. E.g. Flight risk, witness intimidation, or likelihood to do harm to himself or others while on bail.

The exceptional circumstance is that South African jails are extremely overcrowded, and because the magistrate thought he didn't meet any of the other reasons to be held, he released him.

There is no doubt that a murder was committed by him, it's merely the supposed mitigating circumstances that are a matter of debate.

As for your last sentence, just LOL, I'm sure 'prison overcrowding' would have been a factor if it'd have been Adeyemi Bapoto stood in the dock..................

Actually there is doubt, as nothing has been proven. Again, hence the trial. Pistorius denies murder.

How you, a person who has done nothing but read newspaper reports can say there is 'no doubt' a murder has been committed is beyond me.

And yeah, i'm sure the magistrate just made up prison overcrowding to let Pistorius off, shortly after underlining that he thought the prosecution case wasn't weakened by Botha's fumbles.

You're basically accusing the magistrate and SA justice system of racism and pandering to a rich man because it fits your narrative. Cringeworthy.
 
Wouldn't surprise me in the slightest if he did away with himself ,very difficult to see how he wouldn't be found guilty from what has been reported so far.Hell of a fall from grace,top springbok icon to a life in a South African jail,He surely is very vulnerable and unsettled at the moment

lol, what's cringeworthy is you blatantly defending the man & then hiding behind supposed 'impartiality' when questioned on it Brennan.

Pistorius denies murder, but admits firing the gun 4 times that killed his girlfriend. 4 shots aimed at someone is nothing less than an attempt to kill & therefore murder, even if he thought it was an intruder, would firing 4 shots at him, without warning, whilst he was trapped in the confines of his en-suite bog, be acceptable behaviour?

As for your last sentence, don't put words in my mouth thanks all the same, but do you honestly believe that if Adeyemi Bopato was stood in that dock accused of the exact same crime, that 'prison overcrowding' would have been wheeled out as a reason for bail, or that there there'd have been the same view on there being 'exceptional circumstances'?

He shot four times at somebody from close distance without giving them a chance to identify themselves or come out without being killed. He wasn't threatened, he didn't see anybody, he had no reason to believe he was going to come to any danger other than he "heard something in the bathroom". :lol:

Throw away the key.
 
When they have a trial and every single bit of evidence is presented and considered by a judge far more qualified than us, then it'll be known what he definitely did or didn't do. Until then it's all speculation.

I think he's guilty as sin. I don't know this for certain though. Huge difference.
