Dunno about SA, but doesn't murder have to be pre-meditated? Ergo he could be guilty of manslaughter, but not murder.

This is pretty much why he is choosing his words carefully and saying things like "accident" and he didn't know what was happening. He'll take a manslaughter sentence if he can get one I think.

Yeah but as above, he's claiming he did not intentionally (:lol:) pull the trigger; rather that his gun mysteriously went off four times with a pause between the second and third shots, all simply because he heard a noise in the bathroom and didn't bother to check whether it was his girlfriend. Send him down.
 
One thing i have not seen mentioned yet is the fairly obvious accusation.

If it was too dark to see where his GF was, how did he manage to get a fan from somewhere, get his legs on (apparently) find a gun, find the bathroom and fire 4 perfectly good shots into it without being able to visably make anyhting out right next to him?

He wasn't thinking; apparently that gives you superpowers.

He's also not even admitting to when he fired the gun under the table in the restaurant, despite admitting to having it in his hands, it going off and expert testimony that it couldn't have gone off without the trigger being pulled by him.

This totally avoidance of accepting any responsibility for what was an obvious act of bravado inspired idiocy, should cast massive aspersions over his entire defence in the eyes of the judge and I fully expect Nel to major on it in his summing up.

Had him giving all sorts of opinions and analysis on the sock 'used to kick the door', but has just admitted he only drew conclusions that it was his sock because he looked at a photo of the sock and it looked the same as the fibres found on the varnish of the door. lol

And Nel has just have him admit he isn't a blood spattering expert.

God this fella is working me up with his answers, he won't give a straight answer to anything. Nel asks him "Did you ever have the sock in your hand?" and he answers like "I remember on the 15th of November I think it was the sock was in the lab", to Nel replies "You're not answering the question; did you ever have it in your hand?", then he goes a "No."

This 'expert' is making it up as he goes along! He isn't an expert in ballistics, blood spatters or forensic analysis, but the defence have used him as so.

Edit: He's a GEOLOGIST! Wtf! Haha!

Would you trust a geologist to handle a murder scene?
