I listened to a supposed expert giving his view on it last night, and he thought the judge was playing it spot on.
Had she accepted the prosecutions murder charge, then there'd have likely been an appeal against that, and despite being a convincing case and one that is borne out by both probability and common sense, it's hard to say that it's beyond reasonable doubt. So an appeal could have succeeded.
However, in terms of manslaughter there's really no argument, he shot her, he killed her, he acted in an overtly agressive manner when he had other alternatives, there's no real appeal to be had there.
So now it'll come down to the sentencing. If she places what the prosecution considers to be a lenient sentence on him, then they'll likely appeal, however this expert felt that she'll give him a lengthy custodial (7-10 stretch) that'll appease the prosecution and it'll end there.
We'll see.
