@COYBL25 ......phew long , long time since I did this so please excuse my memory.

The Highways Act of 1980 places a duty on Local Authorities to maintain the pavements and roads. If they fail in that duty and an accident occurs as a result they can sued for damages for a " breach of statutory duty ".

However Sec 58 gives them a defence if they can show that they have a reasonable system of inspection to identify defects and spend reasonable resources to repair.

Here we are talking about missing paving stones , rocking paving stones or pot holes. The Court has traditionally said that any defect less than 1" would not give rise to liability.

The 1980 Act never conferred a duty upon the local.authority to grit pavements or clear snow etc and at one point there was a school of legal thoughts that if they did and did so inadequately that would give rise to a claim in negligence.

As a result and because of a paucity of resources gritting pavements has never really been something that the LA do.

They do grit roads but again if there is a RTA as a result of a failure to grit that's unlikely to lead to a successful claim

Slightly off topic, it would appear this is the same reason so many of the grids across the city are blocked, causing flooding on the roads every time it rains.
 

Rock salt is expensive plus the labour to put it down - council staff cut to the bone - Parks departments merged with now Street Clean skeleton staff in the winter temps in the summer when the grass is growing - in my day the parks staff would be doing what you indicate in your post .... LG cut backs & they always root prune - the offices are not as cut back as they should be .... sat in their ivory towers etc ...

Shocked to hear the other day That MPs also sit as paid councillors - worst party for doing this is LIB DEMS almost 50 % of MPs hold a council seat & the Labour Party MPs - if they on committees etc - their pay could be up to £35,000 + so how can they do 2 jobs at once ? Based in London too?

I worked in LG since leaving school, never heard it mentioned that fact - it must be like winning the lottery for them -

Labour were elected to stop MPs in most cases not having two jobs .....

I suggest you find out who your local councillor is in Woolton & ask why the paths are no clear as you pay enough council tax - plus find out if they hold a dual role ? Accountability has gone IMO it's just political greed in general from all parties once elected, or I'm all right Jack attitude ....

Would have thought the grids, and sewers, are the responsibility of United Utilities. Obviously they cannot afford to fully maintain them as they have to pay dividends instead.

No LG - when did you last see a gully sucker vehicle left hand drive in any road cleaning all the drains out in your road ? Used to be at least once per month?

Thanks for that. Must admit I knew the Local Authority was responsible for things like leaves and rubbish that could block access to the drain but thought the drain itself was the water company's responsibility.

The drain if broken is the water boards duty - maintenance is LG cleaning out with the gully sucker vehicles leaves dirts etc so surface water runs....

It’s nuts Joey, as nearly all the flooding on main roads is caused by clogged up grids, which in turn cause proper hazards to road users.

There’s people by us who are unblocking the drains themselves, as they’ve got flooding outside their houses every time it rains.

Contact your Councillor & relate the problem - be firm ask for a gullies sucker vehicle to do all the grids takes minute's..
 

1962/63 - If we had not had steam trains we would have been in the crap as the diesel fuel was freezing solid - the old Crossville buses ground to a halt as the radiators on the buses froze - they needed 100% anti freeze it was like that for 2 & 1/2 months - EFC won the title with no football for 2 & 1/2 months .... 3 games per week to catch up ...

1981 /82 was a bad one too - 34c at night in the North East - we had it bad here too, I had to put 100 % anti freeze in my Vauxhall Viva - that lasted over 2 months too -

No mention of global warming back then & we had big industries ..... Steel - Coal etc etc ....

It's seasonal or freak weather - the population has grown so yes humans do play a part - cutting forests down etc on the weather, & depriving oxygen plants to give out - no doubts, but the whole world has to go green for it to work not just us a tiny island .....
