Yes, but no retrial where the safety of the conviction can be challenged with expert statements. There's been an appeal.
Because they didn't?Yes, but no retrial where the safety of the conviction can be challenged with expert statements.
Why are you under the impression that her defence team doesn't want to turn to the experts who've recently doubted their client's conviction?
yet...Buzzing I didn’t have to do this
Because they didn't?
Dave, there's no denying the NHS and this hospital in particular have some serious issues, but as mentioned earlier, that doesn't mean that Letby isn't also a baby killer. They didn't at the time? I've given the context to that:
Why bother substantially countering the weight of the media withchunt feeding off the institutional intent of the trust and its senior consultants when it made little strategic sense to. It'd have been wasting that argument. And now you can see the wisdom of that strategy as it's being introduced at last in a calmer environment to do so.
It's a legal dance. The choreography of it had to be this way by her defence team, such was the whirlwind of hostility Letby faced in her original trial.
That appeal was based on the validity of the sketchy medical evidence put forward and the failure of the judge in the trial to allow countering expert witnesses in that respect, it wasn't about questioning the statistical methodology used to place Letby at a 'crime scene' umpteen times which forms the line of defence now.No, but there`s been an appeal, where this formed part of the appeal and was subsequently dismissed.
By that reckoning you may as well take everyone who was released on a miscarriage of justice back to prison. The bar you set is too high.Dave, there's no denying the NHS and this hospital in particular have some serious issues, but as mentioned earlier, that doesn't mean that Letby isn't also a baby killer.
Perhaps a part of me, and others, hope that she is innocent if only because I can't comprehend why anyone would murder a baby, to me it seems illogical that anyone would do that, but unfortunately there are nutters out there.
We could talk all day about "beyond all reasonable doubt" on many many cases, I will give you that.By that reckoning you may as well take everyone who was released on a miscarriage of justice back to prison. The bar you set is too high.
But the legal requirement is 'beyond all reasonable doubt'. If you think that still remains the case, fair enough. But a growing body of experts say it doesn't;t and it's a matter of time before a tipping point on this is reached.
But those who painted themselves into a corner will be left where they are: in the corner with nowhere to turn.
Woahhh a retrial wasn’t involved. She has been found guilty surely?yet...
There will be an appeal, and if Dave is right we will be appealing for you to keep your undies on.Woahhh a retrial wasn’t involved. She has been found guilty surely?
You are right that their is a growing clamour from experts. But they aren't actually saying she is innocent, per se, what the experts are saying is they aren't convinced on the merits of her conviction based upon the evidence presented. So a mistrial.By that reckoning you may as well take everyone who was released on a miscarriage of justice back to prison. The bar you set is too high.

This really is falling apart now...
