Times article, Burnley/Leeds threaten to sue Everton

There’s no precedent for what happens if you breach the Rules anyway. The rules don’t state that if you breach profit and sustainability you get a points deduction. So I don’t really see how it impacts them, but given the sums involved they’re probably just trying to get a bit of money out the league. But there’s no Premier League precedent to say we should have had a points deduction.
The rules state that all punishment is available, including points reduction.

Leeds used to hand referees and opposition managers and players brown envelopes full of cash to throw games.

Hard faced gets.

just take it to the court of arbitration for sport anyway they would just suspend any ruling made by the prem regarding a points deduction which would make it unenforceable for this season

leeds and burnley would not benefit at all, it would be the 3 teams potentially at risk of relegation next season who would benefit, similar to derby this season in the championship

I think their owners of both clubs are looking for an excuse on why they are where they are and haven’t spent any money when they could.

Leeds fans hate their owner, and the Burnley owners are a hedge fund who don’t put anything in unless they get a big return.

Our Accounts were published a while back. I don't recall Leeds and Burnley, or anyone else, making a song and dance about it. The Everton has pulled up in the back stretch of the Relegation Stakes while those two runners are still fighting it out..

And you can't go about moaning and demanding retrospective penalties to save your own skin. I guess the Kopites haven't joined in the chorus because they caught a break back around 2010.

But they don’t prescribe a specific punishment. They don’t say “you will be hit with a points deduction”. It’s a premier league discretion, which from a legal perspective generally a discretion has to be exercised “reasonably”. For it to be unreasonable, the premier league would have to tale a decision no reasonable person would take. So it would be very difficult for them to argue we should have had a points deduction.

Then we should all go after Liverpool, for essentially being bankrupt a few years back.
Yes they were very close to administration if not already in it and RBS put that Martin Broughton in as Chief Executive.

Well if ever there was a reason for the bizarre and controversial refereeing we have received in the second half of this season. Perhaps this kind of scenario is the exact reason why
I have said this before on other threads. My thought has always been, because of the finance and the questions it brings up, there could potentially be a way of "forgetting about it" if we got relegated. Just a shame for some it never came to pass.

I think posting loses of 360m when the regulations only allow for 105m would give them scope to do whatever they want, IMO.
